GuidanceforCompletingFormI-9(EmploymentEligibilityVerificationForm)|CurrentasofJuly2023

In1986,CongressreformedU.S.immigrationlawstopreservethetraditionoflegalimmigrationwhileseekingtoclosethedoortounlawfulentry.Theemployersanctionsprovisions,foundinsection274AoftheImmigrationandNationalityAct(INA),wereaddedbytheImmigrationReformandControlActof1986(IRCA).TheseprovisionsfurtherchangedwiththepassageoftheImmigrationActof1990andtheIllegalImmigrationReformandImmigrantResponsibilityAct(IIRIRA)of1996.

EmploymentisoftenthemagnetthatattractspeopletoresideintheUnitedStatesunlawfully.Thepurposeoftheemployersanctionslawistoremovethismagnetbyrequiringemployerstohireonlyindividualswhomaylegallyworkhere:U.S.citizens,noncitizennationals,lawfulpermanentresidents,andothernoncitizenswhoareauthorizedtowork.Tocomplywiththelaw,employersmust:

Theguidanceinthishandbook,intandemwiththeFormI-9instructions,helpsemployersproperlycompleteFormI-9,whichassistsinverifyingthatyouremployeesareauthorizedtoworkintheUnitedStates.YoumustcompleteaFormI-9foreverynewemployeeyouhireafterNov.6,1986,aswellasnewemployeeshiredintheCommonwealthoftheNorthernMarianaIslands(CNMI)onorafterNov.28,2009.ThisincludesU.S.citizensandnoncitizennationalswhoareautomaticallyeligibleforemploymentintheUnitedStates.

Theformconsistsoffiveparts:

FormI-9isavailableinEnglishandSpanish.EmployersintheUnitedStates,exceptPuertoRico,mustcompletetheEnglish-languageversionofFormI-9.OnlyemployerslocatedinPuertoRicomaycompletetheSpanish-languageversionofFormI-9insteadoftheEnglish-languageversion.AnyemployermayusetheSpanish-languageformandinstructionsasatranslationtoolforSpanish-speakingemployees,whencompletingtheEnglish-languageversion.

TheHomelandSecurityActof2002createdanexecutivedepartmentcombiningnumerousfederalagencieswithamissiondedicatedtohomelandsecurity.OnMarch1,2003,theauthoritiesoftheformerImmigrationandNaturalizationService(INS)weretransferredtothreenewagenciesintheU.S.DepartmentofHomelandSecurity(DHS):

ThetwoDHSimmigrationcomponentsmostinvolvedwiththemattersdiscussedinthishandbookareUSCISandICE.USCISissuesmostemploymentauthorizationdocumentationfornoncitizensandadministersFormI-9andE-Verify,whichelectronicallyconfirmsemploymenteligibility.ICEenforcesthepenaltyprovisionsofsection274AoftheINAaswellasotherimmigrationrequirementswithintheUnitedStates.

UndertheHomelandSecurityAct,theU.S.DepartmentofJustice(DOJ)retainedcertainresponsibilitiesrelatedtoFormI-9aswell.Inparticular,theImmigrantandEmployeeRightsSection(IER)intheDOJ’sCivilRightsDivisionenforcestheanti-discriminationprovisioninsection274BoftheINA,whiletheExecutiveOiceforImmigrationReview(EOIR)administrativelyadjudicatescasesundersections274A,274B,and274C(civildocumentfraud)oftheINA.

FormI-9hasbeenthefoundationoftheemploymenteligibilityverificationprocesssince1986,whenemployersbeganverifyingtheemploymentauthorizationandidentityofnewhiresunderIRCA.Toimprovetheaccuracyandintegrityofthisprocess,USCISoperatesanelectronicemploymenteligibilityconfirmationsystemcalledE-Verify.

E-Verifyisaweb-basedsystemthatallowsemployersandotherparticipantstoconfirmtheeligibilityoftheirnewlyhiredemployeestoworkintheU.S.byelectronicallymatchinginformationontheemployee’sFormI-9againstrecordsavailabletotheSocialSecurityAdministration(SSA)andDHS.E-Verifyisfreeandisavailabletoparticipantsinall50states,theDistrictofColumbia,PuertoRico,Guam,theU.S.VirginIslands,andtheCommonwealthoftheNorthernMarianaIslands.

EmployerswhoparticipateinE-VerifymuststillcompleteaFormI-9foreachnewlyhiredemployeeintheUnitedStates.E-VerifyparticipantsmayacceptanydocumentorcombinationofdocumentsfromtheListsofAcceptableDocumentsonFormI-9,butiftheemployeechoosestopresentaListBandCcombination,theListB(identityonly)documentmusthaveaphotograph.EmployeesmustalsoprovidetheirSocialSecuritynumberinSection1oftheFormI-9iftheiremployerisenrolledinE-Verify.

IfyouparticipateinE-Verify,aftercompletingaFormI-9foryournewemployee,youmustcreateacaseinE-VerifythatincludesinformationfromSections1and2oftheemployee’sFormI-9.Aftercreatingthecase,youwillreceivearesponsefromE-Verifyregardingtheemploymentauthorizationoftheemployee.Insomecases,E-VerifywillprovidearesponseindicatingaTentativeNonconfirmation(mismatch).ThisdoesnotnecessarilymeantheemployeeisunauthorizedtoworkintheUnitedStates.Rather,itmeansthatE-Verifyisunabletoimmediatelyconfirmtheemployee’sauthorizationtoworkintheUnitedStates.Inthecaseofamismatch,youmustnotifytheemployee.Iftheemployeewishestotakeactiontoresolveamismatch,theemployeeshouldcontacttheappropriateagency(DHSand/ortheSSA)withintheprescribedtimeperiodstatedintheReferralDateConfirmationthatyouwillprovidetotheemployee,andasdescribedintheE-VerifyUserManual.

WhenusingE-Verify,participatingemployersmustalsofollowcertainproceduresthatweredesignedtoprotectemployeesfromunfairemploymentactions:

E-VerifystrengthenstheFormI-9employmenteligibilityverificationprocessthatallemployers,bylaw,mustfollow.ByaddingE-VerifytotheexistingFormI-9process,participantscanbenefitfromknowingthattheyhavetakenanadditionalsteptowardmaintainingalegalworkforce.

OnNov.14,2008,theCivilianAgencyAcquisitionCouncilandtheDefenseAcquisitionRegulationsCouncilissuedafinalruleamendingtheFederalAcquisitionRegulation(FAR)(FARcase2007-013,EmploymentEligibilityVerification).TheregulationrequirescontractorswithafederalcontractthatcontainstheFARE-VerifyclausetouseE-Verifyfortheirnewhiresandallemployees(existingandnew)assignedtothecontract(48C.F.R.,Subpart22.18).FederalcontractsissuedonorafterSept.8,2009,aswellasoldercontractsthathavebeenmodifiedmaycontaintheFARE-Verifyclause.

YoumustcompleteFormI-9eachtimeyouhireanypersontoperformlabororservicesintheUnitedStatesinreturnforwagesorotherremuneration.Remunerationisanythingofvaluegiveninexchangeforlabororservices,includingfoodandlodging.TherequirementtocompleteFormI-9appliestonewemployeeshiredintheUnitedStatesafterNov.6,1986,aswellasnewemployeeshiredintheCommonwealthoftheNorthernMarianaIslands(CNMI)onorafterNov.28,2009.

EnsuretheemployeereceivestheinstructionselectronicallyorinprintandcompletesSection1ofFormI-9atthetimeofhire.“Hire”meansthebeginningofemploymentinexchangeforwagesorotherremuneration.Thetimeofhireisnotedontheformasthefirstdayofemployment.EmployeesmaycompleteSection1beforethetimeofhire,butnotbeforetheemployerextendsthejoboerandtheemployeeacceptsit.Youmayreviewtheemployee’sdocument(s)andfullycompleteSection2atanytimefromthedatetheemployeeacceptsthejobofferandcompletesSection1towithinthreebusinessdaysfromthedateofhire.Forexample,iftheemployeebeginsemploymentonMonday,youmustcompleteSection2byThursday.

Youmaydesignate,hire,orcontractwithanypersonyouchoosetocomplete,updateormakecorrectionstoSection2orSupplementB,ReverificationandRehire,onyourbehalf,suchasamemberofthegeneralpublic,personnelofficers,foremen,agents,ornotariespublic.Thispersonisknownasyourauthorizedrepresentative.Theauthorizedrepresentativemustperformalltheemployerdutiesdescribedintheinstructionsandthishandbook,andcomplete,signanddateSection2orSupplementB,ReverificationandRehire,onyourbehalf.Youareliableforanyviolationsinconnectionwiththeformortheverificationprocess,includinganyviolationscommittedbytheauthorizedrepresentativeactingonyourbehalf.

USCISdoesnotrequireyoutohaveacontractorotherspecificagreementwithyourauthorizedrepresentativeforFormI-9purposes.Iftheemployerchoosestouseanotarypublicasanauthorizedrepresentative,thatpersonisnotactinginthecapacityofanotary.Thispersonmustperformthesamerequiredactionsasanauthorizedrepresentative,includingsignatures.Whenactingasanauthorizedrepresentative,anotarypublicshouldnotprovideanotarysealonFormI-9.

EmployeescannotactasauthorizedrepresentativesfortheirownFormI-9.Therefore,employeescannotcomplete,update,ormakecorrectionstoSection2orSupplementB,ReverificationandRehireforthemselvesorattesttotheauthenticityofthedocumentationtheypresent.

Ifanemployeewillworkforlessthanthreebusinessdays,Sections1and2mustbefullycompletedatthetimeofhire(inotherwords,bythefirstdayofemployment).

DonotcompleteFormI-9foremployeeswhoare:

Ifyouareself-employed,youdonotneedtocompleteFormI-9onyourownbehalfunlessyouareanemployeeofaseparatebusinessentity,suchasacorporationorpartnership.Inthatcase,youandanyotheremployeesmustcompleteFormI-9.

Note:YoucannothireanindividualwhoyouknowisnotauthorizedtoworkintheUnitedStates.

HavetheemployeecompleteSection1atthetimeofhire(bythefirstdaytheemployeestartsworkforpayorotherremuneration)byenteringthecorrectinformationandsigninganddatingtheform.Iftheemployeeenterstheinformationbyhand,ensuretheemployeeprintsclearly.

Apreparerand/ortranslatormayhelptheemployeecompleteSection1.Employersmustreviewtheinformationandensureemployees(andtheirpreparer/translators,ifapplicable)fullyandproperlycompletedSection1.

Employeesmustentertheircurrentlegalnameandotherlastnamesthattheyhaveusedinthepastorpresent(suchasamaidenname),ifany.

Employeesmustentertheircurrentaddress,apartmentnumber(ifany),cityortown,stateandZIPcode.Iftheresidenceisnotlocatedinacityortown,enterthevillage,county,township,reservation,etc.intheCityorTownField.Employeeswhodonothaveastreetaddressshouldenteradescriptionofthelocationoftheirresidence,suchas“TwomilessouthofI-81,nearthewatertower.”Employeeswhohavenoapartmentnumbermayleavethisfieldblank.BordercommutersfromCanadaorMexicomayentertheircity;provinceorstate;postalcode;andtheircountryabbreviation.

EmployeesmayvoluntarilyprovidetheirSocialSecuritynumberorleavethisfieldblank.However,ifyouareenrolledinE-Verify,youremployeesmustprovidetheirSocialSecuritynumber.

EmployeeswhohavenotyetreceivedtheirSocialSecuritynumberandwhocansatisfyallotherFormI-9requirementsmayworkwhileawaitingtheirSocialSecuritynumber.HavethementertheirSocialSecuritynumberinSection1assoonastheyreceiveit.

EmployeesarenotrequiredtoprovideanemailaddressortelephonenumberinSection1.Iftheydonotwishtoenterane-mailaddressortelephonenumber,theymayleavethesefieldsblank.

Employeesmustreadthewarningaboutpenaltiesunderfederallawandattesttotheircitizenshiporimmigrationstatusbycheckingoneofthefollowingboxesontheform:

Employeesmustsignanddatetheform.Employeeswhocannotsigntheirnamemayplaceamarkinthisfieldtoindicatetheirsignature.

Withinthreebusinessdaysofthedateemploymentbegins,youoryourauthorizedrepresentativemustcompleteSection2byexaminingoriginal,acceptable,andunexpireddocumentation,oranacceptablereceipt,theemployeepresents(seeTable1:SpecialFormI-9Situations)todetermineifitreasonablyappearstobegenuineandrelatestothepersonpresentingit.Forexample,ifanemployeebeginsemploymentonMonday,youmustreviewtheemployee’sdocumentationandcompleteSection2onorbeforeThursdayofthatweek.However,ifyouhiresomeoneforlessthanthreebusinessdays,youmustcompleteSection2nolaterthanthefirstdayofemployment.

Youmayterminateanemployeewhofailstopresentacceptabledocumentation(oranacceptablereceiptforadocument)withinthreebusinessdaysafterthedateemploymentbegins.IfyoufailtoproperlycompleteFormI-9,youriskviolatingsection274AoftheINAandmaybesubjecttocivilmoneypenalties.

Employeesmaychoosetopresenteither:1)onedocumentselectedfromListAor2.)acombinationofoneselectionfromListBandoneselectionfromListC.

DiscriminatingintheFormI-9andE-Verifyverificationprocessescanviolatefederallaw.Thissectiondescribesprohibiteddiscriminationandhowtopreventitwhileverifyinganindividual’semploymenteligibility.

Theanti-discriminationprovisionoftheImmigrationandNationalityAct(INA),asamended,prohibitsfourtypesofunlawfulconduct:

TheU.S.EqualEmploymentOpportunityCommission(EEOC)enforcesfederalequalemploymentopportunitylawsthatprohibitemploymentdiscriminationagainstapplicants,employees,andformeremployees.TheselawsincludeTitleVIIoftheCivilRightsActof1964(TitleVII),theEqualPayAct(EPA),theAgeDiscriminationinEmploymentAct(ADEA),AmericanswithDisabilitiesAct(ADA),andtheGeneticInformationNondiscriminationAct(GINA).TitleVIIprohibitsemploymentdiscriminationbasedonrace,color,nationalorigin,religion,orsex(includingpregnancy,sexualorientation,andgenderidentity),includinginFormI-9andE-Verifyemploymenteligibilityverificationprocesses.

EachofthefederallawsenforcedbytheEEOCalsoprotectsworkersfromretaliationforreasonablyopposingdiscriminationorforparticipatinginadiscriminationinvestigationorproceeding.EEOClawsapplyregardlessofanindividual’scitizenshiporimmigrationstatus.

TheINAprohibitsyoufromcommittingunfairdocumentarypractices,whichmeansdiscriminatingwhenyouverifysomeone’sidentityandemploymentauthorization(generally,theFormI-9andE-Verifyprocesses).Unfairdocumentarypracticesgenerallyoccurwhenemployerstreatindividualsdierentlyonthebasisofnationalorigin,citizenshiporimmigrationstatusintheFormI-9orE-Verifyprocess,oranyotherprocessanemployermayusetoverifyemploymenteligibility.Thiscanbebroadlycategorizedintothreetypesofunlawfulconduct:

Thesepracticesmayconstituteunfairdocumentarypracticesiftheyarecommittedbasedoncitizenship,immigrationstatus,ornationalorigin.

Citizenshiporimmigrationstatusdiscriminationoccurswhenanemployertreatssomeonedierentlywhenhiring,firing,orrecruitingbecauseoftheperson’realorperceivedcitizenshiporimmigrationstatus.TheINAprohibitsthistypeofdiscriminationiftheemployerhasfourormoreemployees.Asylees,refugees,recentlawfulpermanentresidents,U.S.citizensandU.S.nationalsareprotectedfromthistypeofdiscrimination.

Note:Therearelimitedsituationswhereanemployercantakeanindividual’scitizenshiporimmigrationstatusintoaccount,suchaswhenalaw,executiveorder,regulation,orgovernmentcontractrequiresemployerstolimitapositiontoaparticularcitizenshipstatus.Thisisrareanddoesn’tapplytothevastmajorityofjobs.

Nationalorigindiscriminationgenerallyoccurswhenanemployertreatssomeonedierentlywhenhiring,firing,orrecruitingbecauseoftheperson’snationalorigin.Aperson’snationalorigincanrelatetomanythings,suchasplaceofbirth,countryoforigin,ethnicity,ancestry,nativelanguage,accent,ortheperceptionthattheylookorsound“foreign.”TheINA’snationalorigindiscriminationprohibition,enforcedbyIER,generallycoversemployerswith4to14employeesandprotectsallemployment-authorizedindividuals.TheEEOCgenerallyhasjurisdictionovernationaloriginclaimsinvolvingemployerswith15ormoreemployees,regardlessoftheworkauthorizationstatusofthediscriminationvictims.TheEEOCalsocoversdiscriminationinotheraspectsofemployment,includingtermsorconditions.

Anemployerorothercoveredentitycannotintimidate,threaten,coerce,orotherwiseretaliateagainstapersonbecausethatpersonhasengagedinprotectedactivity,suchaswhensomeone:

Anindividual,orapersonactingonbehalfofanindividualmayfileadiscriminationchargewithIERwithin180daysoftheallegeddiscriminatoryact.

Ifsomeonefilesachargeagainstyouasanemployer,IERwillsendaletterwithin10daystonotifyyouaboutthechargeandwillstartitsinvestigation.Ifyourefusetocooperatewiththeinvestigation,IERcanobtainasubpoenatocompelyoutoproducetherequestedinformationanddocumentsortoappearforaninvestigativeinterviewordeposition.

Anapplicant,employee,orformeremployee,oranyindividual,organization,oragencyfilingonbehalfofsuchindividual,whobelievesthatunlawfulemploymentdiscriminationbasedonrace,color,nationalorigin,religion,sex(includingpregnancy,sexualorientation,orgenderidentity),age(40orover),disability,geneticinformation,orretaliationhasoccurredmayfileachargewiththeEEOC.Ingeneral,achargemustbefiledwiththeEEOCwithin180calendardaysfromthedateoftheallegeddiscrimination.Forrace,color,nationalorigin,religion,sex,disability,orgeneticinformationcharges,this180-dayfilingdeadlineisextendedto300daysifastateorlocalagencyenforcesalawthatprohibitsemploymentdiscriminationonthesamebasis.Foragediscriminationcharges,the180-dayfilingdeadlineisonlyextendedto300daysifthereisastatelawprohibitingagediscriminationinemploymentandastateagencyorauthorityenforcingthatlaw.

“Recruiterorreferrerforafee”islimitedtoagriculturalassociations,agriculturalemployers,orfarmlaborcontractorsasdefinedinSection3oftheMigrantandSeasonalAgriculturalWorkerProtectionAct,Pub.L.97-470(29U.S.C.1802).

ThislimitedclassofrecruitersandreferrersforafeemustcompleteFormI-9whenyouhireapersontheyrefer.YouandtheemployeemustfullycompleteFormI-9withinthreebusinessdaysofthedateemploymentbegins,or,inthecaseofanindividualhiredforlessthanthreebusinessdays,atthetimeemploymentbegins.
