In1986,CongressreformedU.S.immigrationlawstopreservethetraditionoflegalimmigrationwhileseekingtoclosethedoortounlawfulentry.Theemployersanctionsprovisions,foundinsection274AoftheImmigrationandNationalityAct(INA),wereaddedbytheImmigrationReformandControlActof1986(IRCA).TheseprovisionsfurtherchangedwiththepassageoftheImmigrationActof1990andtheIllegalImmigrationReformandImmigrantResponsibilityAct(IIRIRA)of1996.
EmploymentisoftenthemagnetthatattractspeopletoresideintheUnitedStatesunlawfully.Thepurposeoftheemployersanctionslawistoremovethismagnetbyrequiringemployerstohireonlyindividualswhomaylegallyworkhere:U.S.citizens,noncitizennationals,lawfulpermanentresidents,andothernoncitizenswhoareauthorizedtowork.Tocomplywiththelaw,employersmust:
Theguidanceinthishandbook,intandemwiththeFormI-9instructions,helpsemployersproperlycompleteFormI-9,whichassistsinverifyingthatyouremployeesareauthorizedtoworkintheUnitedStates.YoumustcompleteaFormI-9foreverynewemployeeyouhireafterNov.6,1986,aswellasnewemployeeshiredintheCommonwealthoftheNorthernMarianaIslands(CNMI)onorafterNov.28,2009.ThisincludesU.S.citizensandnoncitizennationalswhoareautomaticallyeligibleforemploymentintheUnitedStates.
Theformconsistsoffiveparts:
FormI-9isavailableinEnglishandSpanish.EmployersintheUnitedStates,exceptPuertoRico,mustcompletetheEnglish-languageversionofFormI-9.OnlyemployerslocatedinPuertoRicomaycompletetheSpanish-languageversionofFormI-9insteadoftheEnglish-languageversion.AnyemployermayusetheSpanish-languageformandinstructionsasatranslationtoolforSpanish-speakingemployees,whencompletingtheEnglish-languageversion.
TheHomelandSecurityActof2002createdanexecutivedepartmentcombiningnumerousfederalagencieswithamissiondedicatedtohomelandsecurity.OnMarch1,2003,theauthoritiesoftheformerImmigrationandNaturalizationService(INS)weretransferredtothreenewagenciesintheU.S.DepartmentofHomelandSecurity(DHS):
ThetwoDHSimmigrationcomponentsmostinvolvedwiththemattersdiscussedinthishandbookareUSCISandICE.USCISissuesmostemploymentauthorizationdocumentationfornoncitizensandadministersFormI-9andE-Verify,whichelectronicallyconfirmsemploymenteligibility.ICEenforcesthepenaltyprovisionsofsection274AoftheINAaswellasotherimmigrationrequirementswithintheUnitedStates.
UndertheHomelandSecurityAct,theU.S.DepartmentofJustice(DOJ)retainedcertainresponsibilitiesrelatedtoFormI-9aswell.Inparticular,theImmigrantandEmployeeRightsSection(IER)intheDOJ’sCivilRightsDivisionenforcestheanti-discriminationprovisioninsection274BoftheINA,whiletheExecutiveOiceforImmigrationReview(EOIR)administrativelyadjudicatescasesundersections274A,274B,and274C(civildocumentfraud)oftheINA.
FormI-9hasbeenthefoundationoftheemploymenteligibilityverificationprocesssince1986,whenemployersbeganverifyingtheemploymentauthorizationandidentityofnewhiresunderIRCA.Toimprovetheaccuracyandintegrityofthisprocess,USCISoperatesanelectronicemploymenteligibilityconfirmationsystemcalledE-Verify.
E-Verifyisaweb-basedsystemthatallowsemployersandotherparticipantstoconfirmtheeligibilityoftheirnewlyhiredemployeestoworkintheU.S.byelectronicallymatchinginformationontheemployee’sFormI-9againstrecordsavailabletotheSocialSecurityAdministration(SSA)andDHS.E-Verifyisfreeandisavailabletoparticipantsinall50states,theDistrictofColumbia,PuertoRico,Guam,theU.S.VirginIslands,andtheCommonwealthoftheNorthernMarianaIslands.
EmployerswhoparticipateinE-VerifymuststillcompleteaFormI-9foreachnewlyhiredemployeeintheUnitedStates.E-VerifyparticipantsmayacceptanydocumentorcombinationofdocumentsfromtheListsofAcceptableDocumentsonFormI-9,butiftheemployeechoosestopresentaListBandCcombination,theListB(identityonly)documentmusthaveaphotograph.EmployeesmustalsoprovidetheirSocialSecuritynumberinSection1oftheFormI-9iftheiremployerisenrolledinE-Verify.
IfyouparticipateinE-Verify,aftercompletingaFormI-9foryournewemployee,youmustcreateacaseinE-VerifythatincludesinformationfromSections1and2oftheemployee’sFormI-9.Aftercreatingthecase,youwillreceivearesponsefromE-Verifyregardingtheemploymentauthorizationoftheemployee.Insomecases,E-VerifywillprovidearesponseindicatingaTentativeNonconfirmation(mismatch).ThisdoesnotnecessarilymeantheemployeeisunauthorizedtoworkintheUnitedStates.Rather,itmeansthatE-Verifyisunabletoimmediatelyconfirmtheemployee’sauthorizationtoworkintheUnitedStates.Inthecaseofamismatch,youmustnotifytheemployee.Iftheemployeewishestotakeactiontoresolveamismatch,theemployeeshouldcontacttheappropriateagency(DHSand/ortheSSA)withintheprescribedtimeperiodstatedintheReferralDateConfirmationthatyouwillprovidetotheemployee,andasdescribedintheE-VerifyUserManual.
WhenusingE-Verify,participatingemployersmustalsofollowcertainproceduresthatweredesignedtoprotectemployeesfromunfairemploymentactions:
E-VerifystrengthenstheFormI-9employmenteligibilityverificationprocessthatallemployers,bylaw,mustfollow.ByaddingE-VerifytotheexistingFormI-9process,participantscanbenefitfromknowingthattheyhavetakenanadditionalsteptowardmaintainingalegalworkforce.

OnNov.14,2008,theCivilianAgencyAcquisitionCouncilandtheDefenseAcquisitionRegulationsCouncilissuedafinalruleamendingtheFederalAcquisitionRegulation(FAR)(FARcase2007-013,EmploymentEligibilityVerification).TheregulationrequirescontractorswithafederalcontractthatcontainstheFARE-VerifyclausetouseE-Verifyfortheirnewhiresandallemployees(existingandnew)assignedtothecontract(48C.F.R.,Subpart22.18).FederalcontractsissuedonorafterSept.8,2009,aswellasoldercontractsthathavebeenmodifiedmaycontaintheFARE-Verifyclause.
YoumustcompleteFormI-9eachtimeyouhireanypersontoperformlabororservicesintheUnitedStatesinreturnforwagesorotherremuneration.Remunerationisanythingofvaluegiveninexchangeforlabororservices,includingfoodandlodging.TherequirementtocompleteFormI-9appliestonewemployeeshiredintheUnitedStatesafterNov.6,1986,aswellasnewemployeeshiredintheCommonwealthoftheNorthernMarianaIslands(CNMI)onorafterNov.28,2009.

EmployeescannotactasauthorizedrepresentativesfortheirownFormI-9.Therefore,employeescannotcomplete,update,ormakecorrectionstoSection2orSupplementB,ReverificationandRehireforthemselvesorattesttotheauthenticityofthedocumentationtheypresent.
Ifanemployeewillworkforlessthanthreebusinessdays,Sections1and2mustbefullycompletedatthetimeofhire(inotherwords,bythefirstdayofemployment).
DonotcompleteFormI-9foremployeeswhoare:
Ifyouareself-employed,youdonotneedtocompleteFormI-9onyourownbehalfunlessyouareanemployeeofaseparatebusinessentity,suchasacorporationorpartnership.Inthatcase,youandanyotheremployeesmustcompleteFormI-9.
