(1)Subjecttoparagraph(2),thefollowingareunlawful,andwhenfoundbytheCommissiontoexistshallbedealtwith,inadditiontoanyotherprovisionoflaw,asprovidedinthissection:
(一)根据第(二)款,以下情形为非法活动,如委员会发现存在此类活动,应根据本节规定及其他任何法律规定,予以处理:
(A)Unfairmethodsofcompetitionandunfairactsintheimportationofarticles(otherthanarticlesprovidedforinsubparagraphs(B),(C),(D),and(E))intotheUnitedStates,orinthesaleofsucharticlesbytheowner,importer,orconsignee,thethreatoreffectofwhichis—
1、美国货物进口(第2、3、4、5项中列明的货物除外)中,或其所有者、进口商或寄售商销售中,存在以下效果或威胁的不公平竞争方法或不公平行为:
(i)todestroyorsubstantiallyinjureanindustryintheUnitedStates;

2、美国的货物进口,为了进口的销售,或所有者、进口商或寄售商在货物进口到美国后在美国的销售,存在以下情形的:
(i)infringeavalidandenforceableUnitedStatespatentoravalidandenforceableUnitedStatescopyrightregisteredundertitle17;or
(ii)aremade,produced,processed,orminedunder,orbymeansof,aprocesscoveredbytheclaimsofavalidandenforceableUnitedStatespatent.
(2)按照或利用有效的、可执行的受美国专利权利保护的方法制造、生产、加工或开采的货物。
(C)TheimportationintotheUnitedStates,thesaleforimportation,orthesalewithintheUnitedStatesafterimportationbytheowner,importer,orconsignee,ofarticlesthatinfringeavalidandenforceableUnitedStatestrademarkregisteredundertheTrademarkActof1946[15U.S.C.1051etseq.].
3、所有者、进口商或寄售商进口到美国、为进口而销售或进口后在美国销售的货物,侵犯美国有效的、可执行的,根据《1946年商标法》(《美国法典》第15编第1051节)注册的美国商标。
(D)TheimportationintotheUnitedStates,thesaleforimportation,orthesalewithintheUnitedStatesafterimportationbytheowner,importer,orconsignee,ofasemiconductorchipproductinamannerthatconstitutesinfringementofamaskworkregisteredunderchapter9oftitle17.
4、所有者、进口商或寄售商将半导体产品进口到美国、为进口而销售或进口后在美国销售的方式,侵犯根据第17编第9章注册的掩膜产品。
(E)TheimportationintotheUnitedStates,thesaleforimportation,orthesalewithintheUnitedStatesafterimportationbytheowner,importer,orconsigner,ofanarticlethatconstitutesinfringementoftheexclusiverightsinadesignprotectedunderchapter13oftitle17.
5、所有者、进口商或寄售商进口到美国、为进口而销售或进口后在美国销售的货物,侵犯根据第17编第13章受到保护的设计的专有权。
(2)Subparagraphs(B),(C),(D),and(E)ofparagraph(1)applyonlyifanindustryintheUnitedStates,relatingtothearticlesprotectedbythepatent,copyright,trademark,maskwork,ordesignconcerned,existsorisintheprocessofbeingestablished.
(3)Forpurposesofparagraph(2),anindustryintheUnitedStatesshallbeconsideredtoexistifthereisintheUnitedStates,withrespecttothearticlesprotectedbythepatent,copyright,trademark,maskwork,ordesignconcerned—
(A)significantinvestmentinplantandequipment;

(B)significantemploymentoflabororcapital;or
2、对劳动力或资本的实际性雇佣;
(C)substantialinvestmentinitsexploitation,includingengineering,researchanddevelopment,orlicensing.

二、委员会发起调查
(1)TheCommissionshallinvestigateanyallegedviolationofthissectiononcomplaintunderoathoruponitsinitiative.Uponcommencinganysuchinvestigation,theCommissionshallpublishnoticethereofintheFederalRegister.TheCommissionshallconcludeanysuchinvestigationandmakeitsdeterminationunderthissectionattheearliestpracticabletimeafterthedateofpublicationofnoticeofsuchinvestigation.Topromoteexpeditiousadjudication,theCommissionshall,within45daysafteraninvestigationisinitiated,establishatargetdateforitsfinaldetermination.
(2)Duringthecourseofeachinvestigationunderthissection,theCommissionshallconsultwith,andseekadviceandinformationfrom,theDepartmentofHealthandHumanServices,theDepartmentofJustice,theFederalTradeCommission,andsuchotherdepartmentsandagenciesasitconsidersappropriate.
(二)在根据本节发起的每一起调查过程中,委员会应与卫生与人员服务部、司法部、联邦贸易委员会及其他其认为合适的部门进行磋商,并征询意见。
三、裁决及复议
四、排除令
(1)IftheCommissiondetermines,asaresultofaninvestigationunderthissection,thatthereisaviolationofthissection,itshalldirectthatthearticlesconcerned,importedbyanypersonviolatingtheprovisionofthissection,beexcludedfromentryintotheUnitedStates,unless,afterconsideringtheeffectofsuchexclusionuponthepublichealthandwelfare,competitiveconditionsintheUnitedStateseconomy,theproductionoflikeordirectlycompetitivearticlesintheUnitedStates,andUnitedStatesconsumers,itfindsthatsucharticlesshouldnotbeexcludedfromentry.TheCommissionshallnotifytheSecretaryoftheTreasuryofitsactionunderthissubsectiondirectingsuchexclusionfromentry,anduponreceiptofsuchnotice,theSecretaryshall,throughtheproperofficers,refusesuchentry.

(二)排除令仅能适用于委员会裁定本节项下的侵权人,除非:
(A)ageneralexclusionfromentryofarticlesisnecessarytopreventcircumventionofanexclusionorderlimitedtoproductsofnamedpersons;or
1、为了防止出现规避针对特定人的产品的排除令(即有限排除令),必须对有关产品实施普遍禁止入境措施;
(B)thereisapatternofviolationofthissectionanditisdifficulttoidentifythesourceofinfringingproducts.
五、在调查期间排除产品进口(非提供保证金情况下)、适用程序及初步救济
(一)如果在根据本节的调查期间,委员会裁定有理由相信存在本节项下的侵权行为,则可排除上述侵权人的涉案产品进入美国;除非考虑了上述排除进口行为对公共健康和福利、美国经济的竞争状况和美国类似产品或直接竞争产品的生产状况和美国消费者状况后,认为不应排除上述产品的进口。委员会应向财政部长通报根据本节作出的排除进口的决定,财政部长应在受到该通报后,通过有关官员,拒绝有关产品入境;除非上述产品根据财政部长命令提供保证金后(且委员会裁定该保证金金额足以保护申诉人不受损害),有权进口。如果委员会后来裁定应诉人违反本节,则可没收该保证金,并交付给申诉人。
(2)AcomplainantmaypetitiontheCommissionfortheissuanceofanorderunderthissubsection.TheCommissionshallmakeadeterminationwithregardtosuchpetitionbynolaterthanthe90thdayafterthedateonwhichtheCommission’snoticeofinvestigationispublishedintheFederalRegister.TheCommissionmayextendthe90-dayperiodforanadditional60daysinacaseitdesignatesasamorecomplicatedcase.TheCommissionshallpublishintheFederalRegisteritsreasonswhyitdesignatedthecaseasbeingmorecomplicated.TheCommissionmayrequirethecomplainanttopostabondasaprerequisitetotheissuanceofanorderunderthissubsection.IftheCommissionlaterdeterminesthattherespondenthasnotviolatedtheprovisionsofthissection,thebondmaybeforfeitedtotherespondent.
(二)申诉人可请求委员会发布该排除令。委员会应不迟于《联邦公报》上公布发起调查的通知90天后,就该请求作出裁定。如果委员会认为一案件较为复杂,可将该时限延长60天。委员会应在《联邦公报》上就认为该案件较为复杂而作出解释。委员会可要求申诉人提交保证金,作为发布该排除令的条件。如果委员会后来裁定应诉人并未违反本节,则可没收该保证金,并交付给应诉人。
(3)TheCommissionmaygrantpreliminaryreliefunderthissubsectionorsubsection(f)ofthissectiontothesameextentaspreliminaryinjunctionsandtemporaryrestrainingordersmaybegrantedundertheFederalRulesofCivilProcedure.
(三)委员会可根据本条或第六条规定,给予初步救济。初步救济的程度相当于根据《联邦民事程序规则》可作出的初步禁令和临时限制令。
(4)TheCommissionshallprescribethetermsandconditionsunderwhichbondsmaybeforfeitedunderparagraphs(1)and(2).
(四)委员会应就第(一)、(二)款没收保证金的条件和情况作出规定。
六、制止令及违反制止令的民事赔偿
(一)除根据第四条或第五条采取措施外,或与上述措施一起实施,委员会还可对任何违反或根据案情相信违反本节的人发布并对其实施制止令,要求该人停止使用有关不公平方法或实施有关做法;除非,考虑了上述制止令对公共健康和福利、美国经济的竞争状况和美国类似产品或直接竞争产品的生产状况和美国消费者状况后,认为不应发布该制止令。委员会可在任何时候,通过发布其认为合适的通知和利用其认为合适的方式,修改或取消上述制止令;如取消制止令,还可根据案情采取第四条或第五条的措施。除根据第四条或第五条采取措施外,或与上述措施一起实施,委员会可发布临时制止令;在这种情况下,委员会可要求申诉人提交保证金(且委员会裁定该保证金金额足以保护应诉人不受损害),如果委员会后来裁定应诉人并未违反本节,则可没收该保证金,并交付给应诉人。委员会应就本段没收保证金的条件和情况作出规定。
(2)AnypersonwhoviolatesanorderissuedbytheCommissionunderparagraph(1)afterithasbecomefinalshallforfeitandpaytotheUnitedStatesacivilpenaltyforeachdayonwhichanimportationofarticles,ortheirsale,occursinviolationoftheorderofnotmorethanthegreaterof$100,000ortwicethedomesticvalueofthearticlesenteredorsoldonsuchdayinviolationoftheorder.SuchpenaltyshallaccruetotheUnitedStatesandmayberecoveredfortheUnitedStatesinacivilactionbroughtbytheCommissionintheFederalDistrictCourtfortheDistrictofColumbiaorforthedistrictinwhichtheviolationoccurs.Insuchactions,theUnitedStatesdistrictcourtsmayissuemandatoryinjunctionsincorporatingthereliefsoughtbytheCommissionastheydeemappropriateintheenforcementofsuchfinalordersoftheCommission.
(二)在委员会根据第(一)款发布的制止令为最终制止令后,如如何人违反了该制止令,则应被罚款,用以向美国赔付民事赔偿。该赔偿额应不超过每天10万美元(自有关产品的进口或销售侵犯该制止令之日起计算),或2倍于进口或销售产品的国内价值(以违反制止令当日价值计算)。该赔偿的孳息应归美国(政府)所有;该赔偿也可也可基于委员会在哥伦比亚特区联邦地区法院的诉讼而拨付给美国(政府)或侵权行为发生的地区。如果地区法院任何合理,则可以在此类诉讼中发布强制性禁令;该禁令可将委员会计划在最终命令中实施的救济措施合并在内。
七、排除进口或制止令及适用条件和程序
(1)If—
(一)如果
(A)acomplaintisfiledagainstapersonunderthissection;
1、根据本节对某人提起申诉;
(B)thecomplaintandanoticeofinvestigationareservedontheperson;
2、对该人提起申诉并公布了调查通知;
(C)thepersonfailstorespondtothecomplaintandnoticeorotherwisefailstoappeartoanswerthecomplaintandnotice;
3、该人未对申诉及调查通知作出反应,或未能出现以对申诉和调查通知作出答复;
(D)thepersonfailstoshowgoodcausewhythepersonshouldnotbefoundindefault;and
4、该人未能就其不应被裁定存在过错提供有力抗辩;
(E)thecomplainantseeksrelieflimitedsolelytothatperson;
5、申诉人仅针对该人寻求救济;
theCommissionshallpresumethefactsallegedinthecomplainttobetrueandshall,uponrequest,issueanexclusionfromentryoraceaseanddesistorder,orboth,limitedtothatpersonunless,afterconsideringtheeffectofsuchexclusionororderuponthepublichealthandwelfare,competitiveconditionsintheUnitedStateseconomy,theproductionoflikeordirectlycompetitivearticlesintheUnitedStates,andUnitedStatesconsumers,theCommissionfindsthatsuchexclusionorordershouldnotbeissued.
委员会应推定申诉事项属实,并根据要求,发布针对该被申诉人的排除令或/和制止令;除非,考虑了上述排除令或制止令对公共健康和福利、美国经济的竞争状况和美国类似产品或直接竞争产品的生产状况和美国消费者状况后,认为不应发布该排除令或制止令。

(二)除应诉人出现并就其违反本节提起抗辩时委员会可发布普遍排除令外,出现以下情形时,委员会也可以发布普遍排除令,而不管产品进口商的情况:
(A)nopersonappearstocontestaninvestigationconcerningaviolationoftheprovisionsofthissection,
1、没有人就违反本节的调查进行抗辩;
(B)suchaviolationisestablishedbysubstantial,reliable,andprobativeevidence,and
2、违反本节的行为存在充分、可靠、有力的证据;
(C)therequirementsofsubsection(d)(2)ofthissectionaremet.
3、符合第四条第(二)款的要求。
八、对滥用披露和滥诉的制裁
九、没收
(1)Inadditiontotakingactionundersubsection(d)ofthissection,theCommissionmayissueanorderprovidingthatanyarticleimportedinviolationoftheprovisionsofthissectionbeseizedandforfeitedtotheUnitedStatesif—
(一)除根据第四条采取措施外,委员会可在以下情形下发布命令,要求扣留并没收任何违反本节的进口货物:
(A)theowner,importer,orconsigneeofthearticlepreviouslyattemptedtoimportthearticleintotheUnitedStates;
1、货物所有者、进口商或寄售商曾试图将该货物进口到美国;
(B)thearticlewaspreviouslydeniedentryintotheUnitedStatesbyreasonofanorderissuedundersubsection(d)ofthissection;and
2、该货物曾因根据第四条规定发布的命令而被禁止进入美国;
(C)uponsuchpreviousdenialofentry,theSecretaryoftheTreasuryprovidedtheowner,importer,orconsigneeofthearticlewrittennoticeof—
3、在上述禁止进口情况下,财政部长曾对货物所有者、进口商或寄售商提交关于以下事项的书面通知:
(i)suchorder,and
(1)上述命令;和
(ii)theseizureandforfeiturethatwouldresultfromanyfurtherattempttoimportthearticleintotheUnitedStates.
(2)因再次试图将货物进口到美国而对其予以扣押和没收。
(2)TheCommissionshallnotifytheSecretaryoftheTreasuryofanyorderissuedunderthissubsectionand,uponreceiptofsuchnotice,theSecretaryoftheTreasuryshallenforcesuchorderinaccordancewiththeprovisionsofthissection.
(二)委员会应向财政部长通报根据本条作出的任何命令。接到上述通报后,财政部长应根据本节实施上述命令。
(3)Upontheattemptedentryofarticlessubjecttoanorderissuedunderthissubsection,theSecretaryoftheTreasuryshallimmediatelynotifyallportsofentryoftheattemptedimportationandshallidentifythepersonsnotifiedunderparagraph(1)(C).
(三)如发现有人试图进口有关命令(根据本条发布的命令)制裁的货物,财政部长应立即通知所有试图进口的港口,并确认上述第(一)款第3项的人。
(4)TheSecretaryoftheTreasuryshallprovide—
(四)财政部长应提交以下通知:
(A)thewrittennoticedescribedinparagraph(1)(C)totheowner,importer,orconsigneeofanyarticlethatisdeniedentryintotheUnitedStatesbyreasonofanorderissuedundersubsection(d)ofthissection;and
1、如根据第四条作出的命令禁止某货物进口,应向该货物所有者、进口商或寄售商提交上述第(一)款第3项的书面通知;和
(B)acopyofsuchwrittennoticetotheCommission.
2、向委员会提交上述通知的副本。
十、移交给总统
(1)IftheCommissiondeterminesthatthereisaviolationofthissection,orthat,forpurposesofsubsection(e)ofthissection,thereisreasontobelievethatthereissuchaviolation,itshall—
(一)如果委员会裁定存在违反本节的行为,或者根据本节第五条,有理由相信存在此类行为,则应:
(A)publishsuchdeterminationintheFederalRegister,and
1、在《联邦公报》上发布此裁定;
(B)transmittothePresidentacopyofsuchdeterminationandtheactiontakenundersubsection(d),(e),(f),(g),or(i)ofthissection,withrespectthereto,togetherwiththerecorduponwhichsuchdeterminationisbased.
2、向总统转交关于上述裁定及有关措施(即根据第四、五、六、七或第九条采取的措施)的副本,以及上述作出上述裁定所依据的记录。
(2)If,beforethecloseofthe60-dayperiodbeginningonthedayafterthedayonwhichhereceivesacopyofsuchdetermination,thePresident,forpolicyreasons,disapprovessuchdeterminationandnotifiestheCommissionofhisdisapproval,then,effectiveonthedateofsuchnotice,suchdeterminationandtheactiontakenundersubsection(d),(e),(f),(g),or(i)ofthissectionwithrespecttheretoshallhavenoforceoreffect.
(二)如果,在受到上述裁定副本后60天时限结束前,总统基于政策原因否决上述裁决并通知委员会,则在通知当日起,上述裁定及有关措施(即根据第四、五、六、七或第九条采取的措施)应不再有效力或作用。
(3)Subjecttotheprovisionsofparagraph(2),suchdeterminationshall,exceptforpurposesofsubsection(c)ofthissection,beeffectiveuponpublicationthereofintheFederalRegister,andtheactiontakenundersubsection(d),(e),(f),(g),or(i)ofthissection,withrespecttheretoshallbeeffectiveasprovidedinsuchsubsections,exceptthatarticlesdirectedtobeexcludedfromentryundersubsection(d)ofthissectionorsubjecttoaceaseanddesistorderundersubsection(f)ofthissectionshall,untilsuchdeterminationbecomesfinal,beentitledtoentryunderbondprescribedbytheSecretaryinanamountdeterminedbytheCommissiontobesufficienttoprotectthecomplainantfromanyinjury.Ifthedeterminationbecomesfinal,thebondmaybeforfeitedtothecomplainant.TheCommissionshallprescribethetermsandconditionsunderwhichbondsmaybeforfeitedunderthisparagraph.
(三)根据第(二)款规定,上述裁定,除非基于第三条的目的,应于《联邦公报》公布之日起生效;有关措施(即根据第四、五、六、七或第九条采取的措施)应依上述条款的规定而生效,除非被排除进口或被实施制止令(直到上述命令为最终命令)的货物根据财政部长命令,在提供保证金后(且委员会裁定该保证金金额足以保护申诉人不受损害)有权进口。如果裁定为最终裁定,则可没收该保证金,并交付给申诉人。委员会应就没收保证金的条件和情况作出规定。
(4)IfthePresidentdoesnotdisapprovesuchdeterminationwithinsuch60-dayperiod,orifhenotifiestheCommissionbeforethecloseofsuchperiodthatheapprovessuchdetermination,then,forpurposesofparagraph(3)andsubsection(c)ofthissectionsuchdeterminationshallbecomefinalonthedayafterthecloseofsuchperiodorthedayonwhichthePresidentnotifiestheCommissionofhisapproval,asthecasemaybe.
(四)如果总统在60天时限届满后没有否决有关裁决,或在上述时限届满前通知委员会其批准有关裁决,则根据第(三)款及第三条的规定,上述裁决在时限届满或总统通知其批准之日起,成为最终裁决。
十一、有效期、终止侵权及排除令的修改或取消
(1)Exceptasprovidedinsubsections(f)and(j)ofthissection,anyexclusionfromentryororderunderthissectionshallcontinueineffectuntiltheCommissionfinds,andinthecaseofexclusionfromentrynotifiestheSecretaryoftheTreasury,thattheconditionswhichledtosuchexclusionfromentryorordernolongerexist.
(一)除非出现第六条、第九条的情形,任何排除令应一直有效,直到委员会裁定(且已将排除令通知财政部长)导致排除令的情形已不复存在。
(2)IfanypersonwhohaspreviouslybeenfoundbytheCommissiontobeinviolationofthissectionpetitionstheCommissionforadeterminationthatthepetitionerisnolongerinviolationofthissectionorforamodificationorrescissionofanexclusionfromentryororderundersubsection(d),(e),(f),(g),or(i)ofthissection—
(二)如果任何委员会曾裁定违反本节的人向委员会提出申请,要求裁定申请人不再存在违反本节的行为,或要求修改或取消排除令或根据第四、五、六、七或第九条作出的命令:
(A)theburdenofproofinanyproceedingbeforetheCommissionregardingsuchpetitionshallbeonthepetitioner;and
1、申请人应承担所有关该申请的委员会程序的举证责任;
(B)reliefmaybegrantedbytheCommissionwithrespecttosuchpetition—
2、委员会可对下列申请给予补救:
(i)onthebasisofnewevidenceorevidencethatcouldnothavebeenpresentedatthepriorproceeding,or
(1)基于新证据或原先程序中不可能提供的证据的申请;
(ii)ongroundswhichwouldpermitrelieffromajudgmentororderundertheFederalRulesofCivilProcedure.
(2)该申请的事由允许根据《联邦民事程序规则》的裁决或命令给予补救。
十二、美国的进口或为了美国的进口
十三、“美国”的定义
就本节及本编第1338、1440节而言,“美国”一词指《美国协调关税表》注释2所定义的美国关税区。
十四、机密信息的公开
(1)InformationsubmittedtotheCommissionorexchangedamongthepartiesinconnectionwithproceedingsunderthissectionwhichisproperlydesignatedasconfidentialpursuanttoCommissionrulesmaynotbedisclosed(exceptunderaprotectiveorderissuedunderregulationsoftheCommissionwhichauthorizeslimiteddisclosureofsuchinformation)toanyperson(otherthanapersondescribedinparagraph(2))withouttheconsentofthepersonsubmittingit.
(2)Notwithstandingtheprohibitioncontainedinparagraph(1),informationreferredtointhatparagraphmaybedisclosedto—
(二)尽管有第(一)款中的禁止,第(一)款中所述信息仍然可以披露给:
(A)anofficeroremployeeoftheCommissionwhoisdirectlyconcernedwith—
(i)carryingouttheinvestigationorrelatedproceedinginconnectionwithwhichtheinformationissubmitted,

(iv)proceedingsforthemodificationorrescissionofatemporaryorpermanentorderissuedundersubsection(d),(e),(f),(g),or(i)ofthissection,oraconsentorderissuedunderthissection,or
(4)修改或撤销根据本节第四、五、六、七或第九条发出的临时性或永久性命令或者根据本节发出的同意令;或者
(v)maintainingtheadministrativerecordoftheinvestigationorrelatedproceeding,
(B)anofficeroremployeeoftheUnitedStatesGovernmentwhoisdirectlyinvolvedinthereviewundersubsection(j)ofthissection,or

(C)anofficeroremployeeoftheUnitedStatesCustomsServicewhoisdirectlyinvolvedinadministeringanexclusionfromentryundersubsection(d),(e),or(g)ofthissectionresultingfromtheinvestigationorrelatedproceedinginconnectionwithwhichtheinformationissubmitted.
