Cancellingonorafter1AugustafteracceptingyourTenancyAgreementandhavingpaidyourfirstinstalmentofRent
TorequesttocancelyourbookingoutsideoftheDecisionMakingPeriodonorafter31stJulybutpriortotheTenancyStartDateassetoutintheTenancyAgreement,youmustmeetanyofthefollowingcriteria:
1.Yourapplicationforavisahasbeendeclined.Pleasenotethatthisdoesnotincludesituationswhereyourvisahasbeengrantedandsubsequentlywithdrawn.
2.Youhavefailedtoobtainyourgradestostudyatuniversityandassuchdonothavestudentstatus.

IfyoumeetanyoftheaboveCancellationCriteriaandcanprovideuswithevidencedemonstratingthatyoumeettheabovecriteria,yourrequestforcancellationwillbegranted.IfyouhavealreadyacceptedyourTenancyAgreementandpaidyourfirstinstalmentofRentatthedateyourcancellationrequestisgranted,wewillrefundyouthefirstinstalmentofRentlessanyHoldingFeepaid(oranamountequivalenttotheHoldingFeeifyoubookedyourroomafter31stJuly).
IfyouneedtocancelyourbookingoutsideoftheDecisionMakingPeriodonorafter31stJulybutpriortotheTenancyStartDateassetoutintheTenancyAgreementafteracceptingyourTenancyAgreementandhavingpaidyourfirstinstalmentofRentbutcannotmeettheaboveCancellationCriteriayouwillremainliableinfullfortheRentforthefulltermoftheTenancyAgreement.Thisisunlessasuitablereplacementtenantcanbefoundbyyou,acceptanceofwhichwillbeatoursolediscretion.Pleasenotethatwewillnotagreetoareplacementtenantunlessalloutstandingaccountswithusaresettled.
AnydecisionmadetoreleaseyoufromyourTenancyAgreementforanyreasonthatdoesnotfallwithintheCancellationCriteriaismadebyus,atoursolediscretiononacasebycasebasis.

YouagreebyusholdingadepositthatthedeadlinetoconcludetheTenancyAgreementfollowingthereceiptoftheHoldingDepositfeeshallbe14daysthereafter,oranyotherperiodagreedbyus(the“deadline”).

CRMStudentswillmakerelevantcheckstoconfirmyourplaceatuniversityandwillthenmakeyouanOfferofAccommodationwhereyouwillreceiveyouronlineTenancyAgreementviatheStudentPortal.
TheTenancyAgreementsetsoutthefulltermsandconditionsunderwhichyouagreetorentaroomwiththeLandlord,yourguarantorandCRMStudentsLimitedasAgent.
Youwillneedtologintoyouraccount,checkyourdetails,readyourtenancyagreementandsigntheonlinecontractbeforeuploadingrelevantidentificationdocumentation.
YouwillbeaskedtopaythefullyearsrentupfrontunlessyouhaveaUKbasedguarantor.IfyouhaveaUKbasedguarantor,youareabletopayyourrentin3instalments.Thefirstinstalmentneedstobepaid10daysbeforeyourcontractstarts.Youwillnotbeabletomoveintothepropertyifthishasnotbeenpaid.ThesecondrentinstalmentisdueinJanuaryandthefinaloneinApril.Insomecircumstances,wemaybeabletoofferyoua4partpaymentplan,assomestudentloanscomethroughlater,pleasecontactusformoreinformation.
IfforanyreasonwearenotabletomakeyouanOfferofAccommodationwewillcontactyouassoonaspossibledetailingreasonswhyorwithanalternativesolution.IfwecannotofferanalternativeorthealternativeisnotsuitablewewillrefundyourHoldingDepositinfullviatheoriginalmethodthepaymentwasmade.
2.CANCELLATIONBYYOU-14-DAYCOOLINGOFFPERIOD
IfyouchoosetocancelyourbookingwithCRMStudents,youhave14calendardaysafterreceivingtheoriginalAccommodationOffertodosotogetafullrefundoftheHoldingDepositpaid.
Ifyouhavemadeyourbookinglessthan14daysbeforeyouscheduledcheck-indate,youmaycancelyourbookinguntiltheearlierof(a)14daysafterreceiptoftheAccommodationOfferemailand(b)thedateyouactuallycheck-in.
YoumaycancelyourbookingbysendinganemailtotherelevantAccommodationOfficeemailaddresslistedontheindividualsitescontactdetailsonwww.crm-students.com.CRMStudentswillrefundyourHoldingDepositwithin7calendardaysofcancellation.Ifyoucancelyourbookingafterthe14calendardaycooloffperiod,youwillnotgetyourHoldingDepositreturnedtoyouandyou,andyourguarantorifreasonable,willberequiredtomeettheobligationssetoutwithintheTenancyAgreement.
3.PERIODBEFOREYOUENTERINTOYOURTENANCYAGREEMENT
TheLandlordandCRMStudentsreservetherighttonotreturnyourHoldingDepositandcancelyourbookingonnoticeif:
3.1WetakeallreasonablestepstoenterintotheTenancyAgreementbeforethedeadlineandyoufailtodoso,forexample,ifyoufailtocompleteyourapplicationorprovideguarantordetailsandsupportingdocumentationingoodtime;
3.2Youprovideuswithrelevantfalseormisleadinginformation;and/or
3.3WeareprohibitedfromenteringtotheTenancyAgreementbecauseoftheImmigrationAct2014.
4.PERIODFROMANDINCLUDINGWHENYOUHAVEENTEREDINTOTHETENANCYAGREEMENT
IfyouhaveenteredtheTenancyAgreementandyoucancelyourbookingafterthe14calendardaycooloffperiod,youwillnotgetyourHoldingDepositreturnedtoyouandyou,andyourguarantorifreasonable,willberequiredtomeettheobligationssetoutwithintheTenancyAgreementregardlessofwhetheryouhavecollectedyourkeys.
Ifyoucancelyourbookingandareabletofindaneligiblereplacementtenant,subjecttoouragreement,youwillbereleasedfromthecontractualobligationsassetoutintheTenancyAgreement.Anyoverpaidrentwillberefundedtoyou,lessanamountequaltoyourHoldingDepositasacancellationfee.Thesiteteamwillconfirmyourofficialreleasedate.

5.CANCELLATIONSAFTERYOUHAVEMOVEDINTOTHEACCOMMODATION
5.1.Wehopeyouhaveahappystayinyouraccommodation,butifforanyreasonyoudecidetoleaveduringyourcontractedterm,thelandlordmayagreetoreleaseyoufromyourcontract.Providingtheconditionssetoutbelowaremet:5.1.1.YouagreethatyouwillnottransferorsubletthetenancycreatedbytheTenancyAgreementtoanyoneelsewithoutobtainingourwrittenconsentin-linewithpoint11.1(m)oftheTenancyAgreement.
5.1.2.YoufindasuitablereplacementtotakeanewTenancyAgreementforyourroomfortheremainingperiodofyourcontract.5.1.2.1.Replacementtenantsmustbe18yearsoldoroverandenrolledasafulltimestudentinauniversityorcollegeinproximitytotheaccommodation.Wheretheaccommodationhasagreementswithsetuniversitiesthereplacementmayberestrictedtothatuniversity.PleasecheckwithyourAccommodationTeam.
5.1.2.2.TheincomingtenantmustenterintoaTenancyAgreementwithusandpaysumsduewithinthisagreement.
5.1.2.3.Theincomingtenant,wherereasonable,mustprovideasuitableGuarantor.TheGuarantormustaccepttheTermsandConditionssetoutintheTenancyAgreement.
5.1.3.RefundsduewillnotbeprocesseduntilthereplacementtakingoverthecontracthassignedtheTenancyAgreement,paidandmovedintotheaccommodation.
5.1.4.Ifyoudofindsomeonetotakeoveryourcontract,youwillneedtopaya£50administrationfee.
5.1.5.Ifyoufailtofindsomeonetotakeoveryourtenancy,youwillberesponsibleforpayingthefullrentuntiltheendofyourcontractedtimeattheaccommodation.
6.CANCELLATIONSBYCRMSTUDENTSORTHELANDLORD
OurtermsandconditionsrequireyoutosignyourTenancyAgreementonlinewithin14calendardaysofreceivingtheOfferofAccommodation.Ifyoufailtosignyouragreementwithinthistimescalewemaycancelyourbooking,givingnoticebyemail,andyouwillforfeitanybookingfeepaidifitisoutsidethe14calendardaycoolingoffperiodabove.
Ifyoufailtocheck-inonyouraccommodationstartdateandyouhavenotsignedyouragreementwemaycancelyourbookingatanytimebygivingnoticebyemail.Ifyouareoutsidethe14daycoolingoffperiodyourHoldingDepositwillnotberefunded.
OnceyouhavesignedyourTenancyAgreementitmayonlybeterminatedifwemutuallyagreetodosoorinthecircumstancessetoutinpoint3above.
7.1STYEARSTUDENTSWHODONOTGETAPLACEATUNIVERSITY
Thispolicyissitespecificsopleasecheckwiththeindividualsiteforconfirmation.
Youmaybeeligibletobereleasedfromyouragreement,Ifyouareafirstyearprospectiveundergraduatestudentandyourofferofaplaceatyourpreferreduniversity/highereducationinstitutioniswithdrawnasaresultofyounotachievingtherequiredentrygradesoryouhavesurpassedyourrequiredentrygradesandchoosetogotoadifferentUniversity.
Inordertomeetthecriteriayouwillneed:

8.ROOMANDTENANCYCHANGES
ChangetoTenancyLength
Ifyouwishtochangeyourtenancylengthyouwillbeunabletoshortenyourtenancy,butyoucanchoosetoextendwithoutchargeupuntiltheTenancyStartDate(Subjecttoroomavailability).AftertheTenancyStartDateanAdministrationfeeof£50willbepayableshouldyouwishtovaryyourTenancyAgreement.
RoomSwaps
Ifyouwishtoupgradeyourroom,ormovetoadifferentroomtypewhichisthesametypeasyouroriginalchoice,youcandosofreeofchargeupuntiltheTenancyStartDatesubjecttoroomavailability.
Roommovesafterthestartdatewillbesubjecttoroomavailability.Anadministrationchargeof£50willbepayableforthevariationoftheTenancyAgreement.
GoverningLaw
ThesetermsandconditionsshallbegovernedinaccordancewiththelawsofEnglandandWales.

Ifyourofferofaplaceatyourpreferred/currentUniversity/HigherEducationInstitutioniswithdrawnbytheUniversity/HigherEducationInstitutionasaresultofyounotachievingtheirrequiredentrygradesorpassingyourendofyearexams,youmaybeeligibletobereleasedfromthisagreement.YoumayalsobeeligibletobereleasedfromthisagreementifyouareaprospectivefirstyearundergraduatestudentandyouchoosetogotoadifferentUniversitybecauseyouhaveexceededyourexpectedgrades.Toapplytobereleasedfromthisagreementinthecircumstancesreferredtoabove,youwillneedtosupplyuswithacopyof:

ItmaybepossiblewiththeLandlord’sagreementtotransferyourobligationstosomeoneelsewhoiseligibletoliveattheproperty.Thereisnoobligationonourparttofindyouareplacementtenant.Youcanadvertiseyouraccommodationorundertakeyourownsearchforareplacementtenant.Ifyoufindareplacementtenantwewillneedtodosomebasiccheckstoconfirmtheireligibilitytotakeoverthetenancy.

Guarantors
AllapplicantsarerequiredtonominatearesponsiblepersontoactasaGuarantor.TheGuarantormustbeover18yearsoldandhavethemeanstoaccepttheresponsibilitytoactasGuarantorandcannotbesomeonewhoislivingwithyou(otherthanparentsorguardians)orinotheraccommodationmanagedbyus.

AgentmeansHostStudentHousingManagementLimited(companynumber07970795)orHostStudentHousingManagement(UK)Limited(companynumber07970798)whoseregisteredofficeisat9BonhillStreet,London,EC2A4DJ,whichoperatesunderthetradingnameorstyleof“Host”.
ApplicantapersonpursuingorintendingtopursueacourseofstudyatauniversityorhighereducationinstitutionorfurthereducationcollegewhoappliestotheAgentforresidentialaccommodation
BookingProcesstheAgent’son-linebookingprocessforstudentaccommodationatwww.host-students.comorapaper-basedequivalent
BuildingmeansthebuildingorcomplexselectedbytheApplicantduringtheBookingProcessandincludesanyexternalareasatthatlocationthatareownedbytheLandlordandmanagedbytheAgent.
Confirmationmeansconfirmation(intheformofawrittensummaryofthecoretermsofthetenancyagreement)thattheTenanthascompletedtheBookingProcess.
ContentsmeansitemsthattheLandlordprovidesforusebypeoplelivingintheBuilding.
Damagesmeansthesumofmoneypayablebyapersonwhoisinbreachoftheirobligationsinacontracttoapersonwhoincurslossorsuffersexpenseasaresultofthatbreach.Damagesareassessedastheamountofmoneyitwouldtaketoreturnthepersonsufferingloss(orincurringexpense)tothepositiontheywouldhavebeeninifthecontracthadbeenproperlyperformed,assumingtheclaimanthasactedfairlyandreasonably.
FlatmeansaflatattheBuildingconsistingofseveralstudy-bedrooms,eachfortheexclusiveuseoftheauthorisedoccupier(s),andSharedAreasfortheexclusiveuseoftheoccupiersofthestudy-bedroomsinthatflat.
GuarantormeansapersonororganisationreasonablyacceptabletotheLandlordwhohasagreedtoguaranteetheTenant’sobligationsinthetenancyagreement.
InventorymeansthedescriptionoftheRoom,theFlat(whereapplicable)andContentswhichisprovidedtotheTenantatthestartoftheirtenancy.

SharedAreasmeanspartsoftheBuildingoraFlatthatarefortheshareduseofpeoplelivingintheBuildingorinthatFlat.
TenantanApplicantwhohasenteredintoatenancyagreementusingtheBookingProcess.
2.2Areferencetoa“tenancy”includesareferencetoalicence.Otherwordsandexpressionsassociatedwithtenanciesincludetheequivalentexpressionsapplicabletolicences.
2.3IftheRoomhastwobeds,eachoccupierwillhaveaseparatecontractwiththeLandlord.(Thistypeofroomisalsoknownasatwinroomor“twodio”.)
2.4IftheRoomhasonedoublebed(andnosecondbed)andisstatedintheAgent’spre-bookinginformationasbeingfordoubleoccupancy(a“doubleroom”),thentheRoommaybesharedwithanamed“permittedoccupier”,authorisedbytheAgent.TheTenantwillbeliabletopayRentattheapplicableratefordoubleoccupancyiftheTenantsharesadoubleroom.TheTenantwillalsobeliablefortheactionsorneglectoftheirpermittedoccupier.
2.5IftheApplicantdoesnotselectaccommodationthatisstatedduringtheBookingProcessasbeingfordoubleoccupancy,onlytheTenantisallowedtoliveintheRoom.IftheApplicanthasselecteddoubleoccupancyduringtheBookingProcessbutthereisnoauthorisedco-occupier,onlytheTenantisallowedtoliveintheRoom.
2.6IfthesetermsandconditionsrequiretheAgent’sconsent,authority,permissionorsimilar,theAgentwillconfirmitsdecisiontotheTenantinwriting(whichincludeselectronicwrittencommunications).
2.7Areferencetoanygenderincludesallothergenders.
2.8Wordsinthesingularincludetheplural,andwordsinthepluralincludethesingular,wherecommonsenseandthecontextsuggesttheyshould.
2.9Anobligationnottodoanyactorthingincludesanobligationtodowhatisreasonabletopreventorstopsuchanactorthingbeingdonebyanyotherperson.
2.10Whereexamplesaregiveninaclause,thoseexamplesdonotrestricttheinterpretationoftheclauseorlimititsmeaning.
2.11TheAgentisnotapartytothetenancyagreement,but:2.11.1theLandlordhasauthorisedtheAgenttoactastheLandlord’sagentforallpurposesinconnectionwiththeBuilding;
2.11.2notices(includingnoticesinlegalproceedings)maybeservedontheLandlordbygivingorsendingthemtothePropertyManagerattheBuildingoratsuchotheraddressastheLandlordorAgentmaysubsequentlynotifytotheTenantandtheGuarantor;and
2.11.3theAgentmaycarryouttheLandlord’sobligations,andexercisetheLandlord’srights,ontheLandlord’sbehalf.
2.12Ifanytermconditionorprovisioncontainedinthetenancyagreementshallbeheldtobeinvalidunlawfulorunenforceabletoanyextent,suchtermconditionorprovisionshallnotaffectthevaliditylegalityorenforceabilityoftheremainingpartsofthetenancyagreement.
2.13ThesetermsandconditionsshallapplytoanyRoomattheBuildingwhichtheTenantoccupiesfromtimetotime,andtoanyalternativeaccommodationprovidedbyoronbehalfoftheLandlordtotheTenant.
3AgreementforaTenancy
3.1WhenanApplicantcompletestheBookingProcessandtheConfirmationisgenerated,theLandlordagreestoletandtheApplicantagreestotakeatenancyoftheRoomfortheTenancyPeriodattheRent.
3.2TheBookingProcessiscompletedwhentheApplicanthas:3.2.1SelectedfromallthecriteriaofferedintheBookingProcess(Building,Room-type,TenancyPeriodandRent);and
3.2.2Agreedtothesetermsandconditions;andeither3.2.2.1PaidtheapplicableamountofadvanceRentstipulatedduringtheBookingProcessandprocuredaguaranteeagreementsignedbyaGuarantor;or
3.2.2.2PaidtheRentduefortheTenancyPeriodinfull.
3.3ThetenancyagreementisconditionalontheTenantprovidingtotheAgentsuchpersonalidentitydocumentationastheAgentmayreasonablyrequest.TheAgentmayrefusetoissueKeystotheTenantuntilaftertheTenanthasprovidedevidenceofidentity,reasonablyacceptabletotheAgent.
3.4ThetenancywillbeonthesetermsandconditionsandthetermsselectedbytheApplicantduringtheBookingProcess,asshownontheConfirmation.
3.5ThetenancyagreementisforaccommodationattheBuildingofthetypeselectedbytheApplicantduringtheBookingProcess.TheAgentwillnotifytheTenantbeforethestartoftheTenancyPeriodoftheRoomnumberand(ifapplicable)theFlatnumberwherethetenantwillbegintheirtenancy.Theaccommodationmaybesubstitutedbyanalternativefromtimetotime,aspermittedbythesetermsandconditions(seeclauses15to18).
3.6IftheRoomhastwobeds,eachoccupierwillhaveanon-exclusivelicencetooccupytheRoom.Inallothercases,thetenancywillbeanassuredshortholdtenancy.
3.7IfanApplicantarrivesattheBuildingwithouthavingfirstcompletedtheBookingProcess,thePropertyManagerhasthediscretiontoallowtheApplicanttooccupyaroomunderlicenceuntilthenextworkingdayasatemporarymeasure.TheLandlordwillnotgranttheApplicantatenancyorpermittheApplicanttobeginresidentialoccupationorhaveaKeyuntiltheApplicanthascompletedtheBookingProcess.ThePropertyManagermaychargeafeeforanemergencystay,butthatfeewillbedeductedfromtheRentifandwhentheApplicantcompletestheBookingProcess.
4What’sincludedinthetenancyandwhat’sexcludedfromthetenancy
4.1TheRentincludes:4.1.1TheexclusiverighttooccupytheRoomandtousetheContentsinitduringthetenancy(butinthecaseofRoomswithtwobeds,anddoublerooms,thisrightissharedwith,anddoesnotexclude,theotherauthorisedoccupier);
4.1.2thenon-exclusiverighttousetheSharedAreasservingtheRoom,andtheContentsinthoseSharedAreas,fortheirintendedpurpose,duringthetenancy(butadditionalchargesapplytosomefacilitiessuchasanylaundryorgymattheBuilding);
4.1.3areasonableamountofelectricityand(ifconnected)gas(butadditionalchargesmayapplyforexcessiveuse);
4.1.4wateranddrainage;
4.1.5maintenanceandrepairoftheBuildingandContents(butthecostcanbeclaimedfromtheTenantwheretheTenantisatfault);
4.1.6insuranceoftheBuilding;
4.1.7personalpossessionsinsurance(termsandconditionsapply);
4.1.8broadband;
4.1.9TVlicencesinSharedAreasoutsideFlats;
4.1.10cleaningoftheSharedAreasoftheBuildingthatarenotinsideaFlat;
4.1.11anythingelsestatedontheAgent’swebsiteasbeingincludedintherentalpackagefortheRoom.
4.2TheRentdoesnotinclude:4.2.1thecostsofremedyingaccidentalordeliberatedamageorbreakages;
4.2.2excessiveuseofelectricityand/orgas;
4.2.3cleaningtotheextentitisneededbecausetheoccupiershavefailedtotakepropercare;
4.2.4chargesforuseofon-sitefacilitiesthatarepayablelocally(suchasthelaundry);
4.2.5counciltax;
4.2.6atelevisionlicence(whichisneededforwatchingorrecordingprogrammesastheyarebeingshownontelevision,orliveonanonlinetelevisionservice,orfordownloadingorwatchingBBCprogrammesoniPlayer,onanydevice(includinglaptop,mobilephone,tabletorgamesconsole))fortheRoomorforanySharedAreaswithinaFlat.
4.3IftheLandlordortheAgentpaysontheTenant’sbehalfforanyutilityorcommunicationsservice,counciltax,ortelevisionlicencethatisnotincludedinclause4.1,theTenantshallreimbursetheLandlordwithin14daysofrequest.(CounciltaxmaybepayableiftheTenantceasestobeastudent,orifsomeonewhoisnotastudentlivesinthesameRoomorFlatastheTenant).
4.4ThetenancyisoftheRoom,butduringtheTenancyPeriodtheTenanthastheright(jointlywithothers)tousetheSharedAreasallocatedtotheRoom,andtherighttousetheContentsintheRoomandinthoseSharedAreasfortheirintendedpurpose.
4.5TheLandlordreservesforitself,theAgent,andpersonscarryingoutworkontheirbehalftherighttoentertheRoomatanytimeinanemergency;duringthedaytimetocarryoutrepairsrequestedbytheTenant;oratotherreasonabletimesaftergivingreasonableadvancenotice(whichdoesnotneedtobeinwriting)forthepurposesofwelfare,viewings,inspection,cleaning,maintenance,repairandforanyotherreasonablepurpose.
4.6TheLandlordandtheAgentmayentertheSharedAreasinaFlatforanypurposeatanytime,butunlessthereareunusualcircumstancestheywillonlydosobetweenthehoursof8.00amand6.00pmandwillaimtogiveadvancenoticewherepracticable.
4.7TheLandlordhastherighttocarryoutanyalterationsorbuildingworksattheBuildingoronitsadjoiningneighbouringpropertywithoutliabilityfordisturbanceprovidedthat(unlessthereisanemergency)theLandlordhasusedreasonableendeavourstocarryoutworksattimeslikelytominimisedisturbanceandforasshortaperiodasreasonablypracticable.
5Rent
5.1TheTenantpromisestopaytheRenttotheLandlordbydebitcard,creditcardorbanktransferintheinstalmentsandonorbeforethePaymentDates.
5.2IftheTenantdoesnotpayRentwithin14daysofthedateitfallsdue,theTenantmustpaytheLandlordadefaultchargeofinterestattherateof3%abovetheBankofEngland’sbaserateontheoverdueamountfromtheapplicablePaymentDateuntilthedatepaymentismade.
5.3TheRentmustbepaidinGBpoundssterlingandclearedfunds(sotheTenantmayneedtoarrangepaymentseveraldaysinadvanceoftheduedateforpayment,toallowtimeforthebankstoprocesspayments).
5.4TheLandlordmayclaimDamagesfromtheTenantforanylosssufferedorexpenseincurredbytheLandlordortheAgentasaresultoftheTenant’sfailureproperlytoarrangepaymentofRent(suchasfeeschargedbytheAgent’sbankasaresultofforeigncurrencytransactions,orfailedcardpayments).
5.5ThefirstinstalmentofRentshownontheConfirmationincludesanyRentpaidduringtheBookingProcess.TheTenantshoulddeductthatadvancepaymentwhenmakingthefirstinstalment.Forexample,ifthefirstinstalmentofrentis£3,300andtheTenantpaid£300RentduringtheBookingProcess,theTenantmustpaythebalanceofthefirstinstalment(£3,000)onorbeforethefirstPaymentDate.
6DefaultchargesandDamages
6.1IftheTenant’sfailuretocomplywiththetenancyagreementresultsinlossorexpensetotheLandlord(ortheotherwayround)then,totheextentitbehavesreasonably,thepersonwhosuffersthelossorincurstheexpenseisentitledtobeputbackinthesamefinancialpositionastheywouldhavebeeniniftheotherpersonhadcomplied.Theamountofmoneyitwilltaketodothisisknownas‘damages’orcompensation.AclaimforDamagesbroughtbytheLandlordmayincludelossessufferedorexpensesincurredbytheAgent,andreasonableadditionalchargesimposedontheLandlordbytheAgentforadditionalworkithastodoasaresultoftheTenant’sbreachofobligationsinthesetermsandconditions.
6.2TheLandlordand/ortheAgentwillnotifytheTenantofanyallegedbreachofthetenancyagreement,statetheamountbeingclaimedinDamagesordefaultcharges,andprovideevidenceinsupportoftheirclaim.IftheTenantdoesnotagreetopaytheamountclaimed,theLandlordmaytaketheTenanttocourtandseekanorderforpayment.Ifcourtactionisnecessary,theTenantmaybeorderedbythecourttopaytheLandlord’scourtfeesandlegalfeesinadditionto,oraspartoftheLandlord’sclaimfor,Damagesordefaultcharges.
6.3TheLandlordwillnotclaimDamagesforthingswhichare:6.3.1reportedpromptlyatthestartofthetenancyasinventorydiscrepancies;
6.3.2causedbyfairwearandtear;
6.3.3causedbyriskscoveredbytheLandlord'sinsurancepolicy(unlesstheinsurerrefusestopaybecauseofanactionorneglectbytheTenantortheirguest);
6.3.4theLandlord’sresponsibilityunderclause12orunderthegenerallaw;or
6.3.5causedbyanintruder(providedtheTenantcompliedwiththeirobligationsrelatingtosecurity(seeclause9).
6.4WhereabreachofthesetermsandconditionsrelatestotheSharedAreasandtheculpritcannotbeidentified,theLandlordwillgivenoticeoftheassociatedcoststoalltheresidentsentitledtousetheSharedAreasinquestion.TheTenantwillhavetherighttoappealagainstfurtheractionbywritingtothePropertyManagerwithin7daysofthedateofthenotification.ThePropertyManagerwillreviewtheTenant’sappealandgiveadecisionwithinafurther14days.UnlesstheTenantcanprovethattheywerenotattheBuildingatthetimethebreachofthesetermsandconditionsoccurred,itislikelythattheTenantwillbeincludedinanyclaimforDamagesrelatingtotheSharedAreasthattheyuse.
6.5TheLandlordisentitledtomakeanyclaimforDamagesfromeitherorboththeTenantsiftheRoomhastwobeds(evenifeachTenanthasaseparatetenancyagreement)orifadoubleroomislettojointTenantsif,despitereasonableendeavourstheAgentisunabletoestablishwhichTenant’sactionsorneglectcausedtheLandlordlossorexpense.
6.6IftheRoomhasadoublebedandtheAgenthasauthorisedsomeoneelsetoliveintheRoomwiththeTenant,theTenantisresponsiblefortheactionsorneglectofthepermittedoccupier.6.7Iffiresafetyequipmenthasbeenmis-usedortamperedwith,theLandlordwillclaimaminimumof£30inDamages(tocompensatetheLandlordforhavingtoinspectandtesttheequipment)inadditiontotheproperlyandreasonablyincurredcostsofrepairing,servicingorreplacingtheequipmentiftheinspectionshowsrepair,servicingorreplacementtobereasonablynecessary.
6.8TheLandlordwillmakeavailableattheBuildinganindicativelistoftheamountsthatarelikelytobeclaimedinDamagesforreinstatementifreinstatementisrequiredasaresultofabreachofthesetermsandconditions.WhenclaimingDamages,theLandlordwillmakeareasonableallowancefordepreciation,andfairwearandtear.
6.9Inadditiontothecostoflabourandmaterialspaidtothirdparties,theLandlord’sclaimforDamagesmayincludeareasonableamountfortheAgent’stimeinvolvedinarrangingfortheworktobedoneandprocessingcontractors’invoices.
6.10TheLandlorddoesnotneedtohireathirdpartytomakegood,andcanclaimareasonableamountfromtheTenantiftheLandlordortheAgentcarriesoutworkitselftorestoretheRoom,SharedAreasand/orContentstotheconditiontheywouldhavebeeniniftherehadnotbeenabreachofthesetermsandconditions.
6.11TheLandlordmayclaimDamagesfromtheTenanttocompensatetheLandlordforreasonablefees,costsandexpensesreasonably,properlyandactuallyincurredorpayablebytheLandlordinconnectionwithenforcinganyoftheTenant’sobligationsinthetenancyagreementbyanyreasonablemeans,whetherduringoraftertheendoftheTenancyPeriod.
6.12Ifnodateforpaymentisspecifiedinthesetermsandconditions,orinanycourtorder,theTenantagreestopayallDamagesanddefaultchargeslawfullyduetotheLandlordwithin14daysoftheLandlord’sinvoice.
7TakingcareoftheRoom,theSharedAreasandtheContents
7.1TheLandlordwillusereasonableendeavourstoensurethatatthestartoftheTenancyPeriodtheRoomandSharedAreasandtheirrespectiveContentsareingoodcleancondition.
7.2TheTenantwillchecktheInventoryonarrivalandagreestonotifytheAgentofanydeficienciesintheconditionandrepairoftheRoom,theSharedAreasservingtheRoomand/ortheirrespectiveContentswithin48hoursofreceivingtheKeytotheRoom.IftheTenantdoesnotnotifytheAgentofanydiscrepanciesintheInventoryattheoutset,theTenantmayfinditdifficultlatertoprovethattheyarenotresponsibleforanydefect.
7.3TheTenantagreestotakepropercareoftheRoomanditsContents,keepthemcleanandnotdamagethem.
7.4TheTenantagreesnottoremoveanyoftheContentsfromtheroomsinwhichtheywerelocatedatthestartoftheTenancyPeriod.
7.5IfinstructionsareprovidedfortheoperationofanyContents,theTenantmustfollowthoseinstructions(failuretodosomayinvalidateaguarantee,andtheLandlordwouldclaimagainsttheTenantforlossesitsufferedasaresult).
7.6TheTenantagreesthathewill(jointlywiththeotheroccupiersoftheFlat)takepropercareoftheFlatandtheContentsintheSharedAreasoftheFlat,keepthemcleanandnotdamagethem.TheTenantagreestocarryoutafairshareofcleaningintheSharedAreasoftheFlat.ThisclausedoesnotapplyiftheRoomisaself-containedstudio.
7.7Thisclause7.7appliesonlytoRoomswithtwoTenantsandRoomswithasoleTenantandapermittedoccupier.TheTenantagreesthathewill(jointlywiththeotheroccupieroftheRoom)takepropercareoftheRoomanditsContents,keepthemcleanandnotdamagethem.EachoccupieragreestocarryoutafairshareofcleaningintheRoom.
7.8TheTenantagreesthathewill(jointlywiththeotheroccupiersoftheBuilding)takepropercareoftheSharedAreasoftheBuildingthatarenotinsideaFlat,andtheirContents,andwillnotdamagethem.
7.10TheTenantshallcomplywiththeAgent’swastedisposalplanaspublicisedattheBuilding,recyclingmaterialswherepossible.TheTenantshalltakepropercarewhendisposingofrubbishtopreventinjurytoothersortotheenvironment,andwillonlyplacerubbishintheareasdesignatedbytheAgentforthepurpose.
7.11TheTenantisnotliablefordamagecausedbyfairwearandtearorbytheoccurrenceofariskwhichtheLandlordhasinsuredagainst(unlesstheinsurerrefusestopaybecauseofsomeactorneglectbytheTenantorapersonforwhomtheTenantisresponsible).
7.12AnydamagecausedasaresultoftheTenant’sfailuretocomplywiththisclauseshallnotbetreatedasfairwearandtear.TheTenantagreesnotto:7.12.1affixanythingtoanysurfaceoftheRoomortheSharedAreas(otherthanbyusingpinsinthepinboardsprovidedforthatpurpose);
7.12.2paint,stain,varnish,wallpaperorotherwisedecorateanypartoftheBuilding;
7.12.3interferewithanyfiresafetyequipmentoranyelectrical,gas,plumbingortelecommunicationsinstallationintheBuilding;
7.12.4smoke,orburnincense,lightoillampsorcandles,oruseanythingelsethatsmouldersorhasanakedflame,insidetheBuilding;
7.12.5putanythingharmful,orlikelytocauseablockage,intosinks,toilets,showersorotherinstallations;
7.12.6installanyoutdooraerial,satellitedish,orwirelessrouterattheBuilding;
7.12.7keepanyanimatebeingintheBuilding,exceptforananimalthathasundergonearecognisedtrainingprogrammeforassistancewithadisabilityandhasbeenauthorisedbytheAgent(suchauthorisationnottobeunreasonablywithheldordelayed,butmaybegivensubjecttoreasonableconditions);
7.12.8useanykitchenapplianceattheBuildingexceptindesignatedkitchenareas(additionalconditionsapplyinclause9toelectricalitems);
7.12.9drylaundryonheaters;
7.12.10changeanylocks;
7.12.11allowrubbishtoaccumulateordoanythingelselikelytoattractpestsorvermin;
7.12.12delayinreportinganydefecttotheAgent(suchas,butnotlimitedto,damage,disrepair,malfunction,infestation,missingitems,interruptionofutilitysupplies).
7.13ThedescriptionoftheBuildingontheAgent’swebsitewillconfirmwhetherornottheBuildinghasparkingand/orbicyclestorage.TheTenantagreesnottobringanyvehicletotheBuildingiftheBuildingdoesnothaveresidents’parkingorbicyclestorage.TheTenantagreesthatinothercasestheTenant(andtheirguestsorpermittedoccupiers)willnotkeeporleaveunattendedanyvehicleattheBuildingotherthan:
7.13.1afterobtainingtheAgent’spriorwrittenconsent(whichwillnotbeunreasonablywithheld),avehicletoassistwiththeTenant’sortheirguest’sorpermittedoccupier’sdisability(andonlytobringthatvehicleindoorsifsuitableforindooruse);and/or
7.13.2abicycle,whichmaybekeptinadesignatedbicyclestorageareabutmustnotbebroughtindoors.
7.14Clause7.13doesnotpreventvehiclescallingattheBuildingforloading,unloading,pickinguporsettingdownpassengers,aslongasthevehiclesinquestiondonotcauseanuisanceanddriverscomplywiththeAgent’sreasonableinstructionsandlocalhighwaysregulations.
7.15TheTenantmustcomplywithanyoftheLandlord’sinsurers’recommendationsorstipulationsthatarenotifiedtotheTenantfromtimetotime.
8Respectforothers
8.1TheTenantshallnotcausenuisance,annoyanceordisturbancetoothers.Withoutinanywaylimitingthatgeneralobligation,theTenantshall:8.1.1notthreaten,harass,bully,abuseoruseviolencetowardsanyperson;
8.1.2notmakeanynoisefrominsidetheRoomthatisaudibleoutsidetheRoom,ornoiseintheSharedAreasthatisaudibleoutsidethoseSharedAreas,betweenthehoursof11.30pmand8.30am,andatothertimestheTenantshallnotmakenoiseofanykindthatislikelytointerferewiththestudy,sleeporcomfortofotherresidentsoftheBuilding,peopleworkingintheBuildingandpeoplelivingneartheBuilding;
8.1.3nottakeanythingthatbelongstosomeoneelse,oruseanythingbelongingtoanotherwithouttheowner’spermission;
8.1.4respecttheprivacyofothers;
8.1.5notcongregateinlargegroupsinawaythatobstructstheSharedAreasorcreateshighlevelsofnoise;
8.1.6fairlyshareaccesstofacilitiesandamenitiesintheBuildingwithothersentitledtousethem;
8.1.7notdistributeleaflets,flyersorsimilarintheBuilding;
8.1.8nottrytosellanythingintheBuilding;
8.1.9treatotherswithcourtesyandconsideration.
8.2TheTenantshallcomplywithapplicablelawssoasnottoadverselyaffecttherightsandfreedomsofothersintheBuildingorbringtheLandlordortheAgentintodisrepute.Withoutinanywaylimitingthatgeneralobligation,theTenantshall:8.2.1nothaveattheBuildinganyunlawfuldrugorpsychoactivesubstance;
8.2.2notbringanyweapon(eveniflicensed,ceremonial,atoyorareplica),oranythingintendedtobeusedasaweapon,totheBuilding;
8.2.3complywithregulationsandfollowguidanceformanagingthespreadofcontagiousdiseases.
8.3TheTenantshalltakeresponsibilityforvisitorsthattheTenantinvitestotheBuilding,andanypermittedoccupierlivingwiththeTenantinadoubleroom.Withoutlimitingthatgeneralobligation,theTenantshall:8.3.1beliabletopayDamagesforanylossessufferedorexpensesincurredbytheLandlordortheAgentasaresultofanyactorneglectbytheTenant’svisitororpermittedoccupier;

8.3.3notinviteanychildrenundertheageof5totheBuilding;
8.3.4ensurethatanychildrenbetweentheagesof5and18whomtheTenantinvitestotheBuildingareaccompaniedbyaresponsibleadultatalltimes;
8.3.5makesuretheTenant’svisitorsbehaveinawaythatisconsistentwiththesetermsandconditions,whilstattheBuilding;
8.3.6notallowanyvisitortosleepintheSharedAreas;
8.3.7notallowanyvisitortostayovernightexceptforonevisitoratatimeintheRoomandforamaximumof3nights(andinthecaseofaRoomwithtwosinglebeds,onlyiftheotherTenantagrees);
8.3.8notobstructtheAgent’sstaffiftheyaskavisitortoleavetheBuilding;
8.3.9notinvitebacktotheBuildinganyvisitorwhomtheAgenthaspreviouslyaskedtoleave;
8.3.10leavevisitorsintheBuilding,orgivevisitorsaccesstotheBuilding,whentheTenantisnotattheBuildinghimself;
8.3.11notpartwithpossessionofanyKey.
9SafetyandSecurity
9.1TheTenantmustcomplywiththeAgent’sguidanceonsafetyandsecurityandco-operateatalltimeswiththeAgent’sstaffandtheemergencyservicesonmattersrelatingtosafetyandsecurity.
9.2TheTenantagreestoattendanysafetymeetingarrangedbytheAgentattheBuilding;
9.3TheTenantagreesnottodoanything,orneglecttodoanything,whichmaycauseafirehazard,including(butnotlimitedto):9.3.1tamperingwithfiredoorsoranyfiredetection,preventionorcontrolequipment(whichis,inanyevent,acriminaloffencethatcouldresultinafineand/orprisonsentence);
9.3.2smokingtobaccoorothersubstancesinanypartoftheBuilding,orwithin5metresoftheexternalwallsoftheBuilding(smokingintheinternalSharedAreasisanoffence,forwhichtheperpetratorcouldbefinedifconvicted);
9.3.3usingcandles,oilburners,incenseburners,josssticks,shishapipes,e-cigarettesorothervapeproducts;
9.3.4storingorusingfireworksinoraroundtheBuilding;
9.3.5obstructingcorridors,stairwells,orfireescapes;
9.3.6usingexitswithoutreasonablecauseiftheyarearedesignatedasbeingsolelyforescape;
9.3.7bringingintotheBuildinganyadditionalheaters;
9.3.8bringingintotheBuildinganyfurnitureorlargedomesticappliances(including,butnotlimitedto,appliancesforrefrigeration,freezing,cooking,launderingandtumble-drying);
9.3.9usingdeepfatfryers,portablegrills,ricecookers,barbecuesandsimilarheat-generatingappliances.
9.4TheTenantagreesthattheAgentmayremovefromaRoom,FlatortheBuildinganyiteminthepossessionorcontroloftheTenant(orapermittedoccupier)thatitisillegaltopossessorwhichinthePropertyManager’sopinion(actingreasonably)islikelytoputthehealth,safety,welfareorpropertyofanypersonatriskofseriousharm.ThePropertyManagerwillgivetheTenantareceiptfortheitemandunlessitisunsuitableforsafestorage(forexample,ifhighlyinflammable,illicit,oranimate)willreturntheitemtotheTenantattheendofthetenancy.TheAgentmaydisposeofitemsthatareconsideredunsuitableforstorageinsuchmannerasitseesfit,withoutliabilitytotheTenantorotherowneroftheitem.
9.5TheTenantagreestovacatetheBuilding(andensureanypermittedoccupierandtheTenant’svisitorsdoso)immediatelywheneverthefirealarmissounded,havingdueregardtothefireevacuationproceduresontheAgent’swebsiteandoutlinedinanyfireplanondisplayattheBuilding.
9.6TheTenantmustnottamperwith,remove,damage,orinanywayadjustsafetycontrolstoanywindowsandmustnotoverrideanysafetymechanismwhichisintendedtorestrictthewayinwhich,ortheextenttowhich,windowsintheBuildingopen.
9.7TheTenantmustnotinanywayobstructanyaccessorexitroutetoorfromtheBuilding,inparticular(butwithoutlimitingthatgeneralobligation)theTenantmustnotobstructanyroutewhichislikelytobeusedbyemergencyservicevehiclesorforthepurposesofemergencyescape.
9.8TheTenantagreestosecurethedoorandwindowoftheRoomwhenleaving,tosecurewindowsanddoorsoftheSharedAreasofaFlatwhenenteringorleavingtheFlat,andtosecurethemaindoortotheBuildingwhenenteringorleavingtheBuilding.
9.9TheTenantmustkeeptheirKeyswiththemwhennotintheRoomandmustnotcopy,shareorpartwithKeys.(IftheAgenthasauthorisedtwopeopletoliveintheRoom,eachwillbeissuedwiththeirownKeysfortheirsoleuse).
9.10TheTenantmustreportanylostKeyassoonasreasonablypracticabletotheAgentandpayadefaultchargeequaltothecostsreasonablyincurredinreplacingtheKey(includinglockreplacementif,intheAgent’sreasonableopinion,thatwouldbeasensibleprecaution)within14daysofdemandsupportedbywrittenevidenceoftheamountclaimed.
9.11TheTenantmustreporttotheAgentpromptly(andinanyeventwithin48hours)afterbecomingawareofanyaccidentorsecurityincidentandwill,ifrequested,provideacompletedaccidentorincidentformtotheAgent.
10Restrictionsonoccupancyanduse
10.1Nothinginthisclause10preventstheTenantfromsharingtheRoomwithapersonwhohasbeenauthorisedbytheAgenttoliveintheRoomwiththeTenant(butauthorisationwillonlybegivenwheretheRoomisdesignatedduringtheBookingProcessasbeingforoccupancybytwopeople).
10.2TheTenantagreestousetheRoomonlyasastudyandlivingaccommodationfortheTenant.
10.3TheTenantconfirmstotheLandlordthat:10.3.1theTenantisawarethattheBuildingmayonlybeusedforoccupationwhollyormainlybystudents;
10.3.2atthestartoftheTenancyPeriodtheTenantwillbeafull-timestudentregistered,orabouttoberegistered,atafurtherorhighereducationalinstitutionoruniversity;and
10.3.3theTenantwill,within14daysofrequest,providetheLandlordwithacertificateofenrolmentatauniversityorhighereducationinstitutionorfurthereducationcollegeand/oracertificateofexemptionfrompaymentofcounciltax.
10.4TheTenantmustonlyusetheSharedAreasandContentsfortheirintendedpurpose.
10.5TheTenantmustnotcarryoutabusiness,tradeorprofessionattheBuilding.
10.6Exceptforvisitorspermittedbyclause8.3,andasmentionedinclause10.1,theTenantmustnotsharepossessionoroccupation,orpartwithpossessionoftheRoom.
10.7TheTenantmustnotallowanyonetousetheSharedAreasoftheFlatotherthanapersonwhohasbeenauthorisedbytheLandlordortheAgent(suchasatenantofaroomintheFlat)ortheirinvitedvisitor.
10.8TheTenantagreesnottoassign(transfer)thetenancyagreementorthetenancytoanyoneelse,orsub-letorgrantanyonealicencetooccupytheRoomoranySharedAreas,ortakeinpayingguests.IfanyoneotherthantheTenantpaystheRent,paymentwillbeacceptedasapaymentmadeonbehalfoftheTenant,andwillnotgivethepayeranyrighttooccupytheRoom.
10.9Insomelocations,itisabreachofplanningregulationsforoccupiersoftheBuildingtousemotorvehiclesinthecity,exceptforthepurposeofunloadingandloadingatthestartandtheendofthetenancy.IftheBuildingisspecifiedinpre-bookinginformationontheAgent’swebsite,orduringtheBookingProcess,asbeingsubjecttorestrictionsonmotorisedtransport,theTenantmustnotuseanymotorvehicleinawaythatwouldinfringetheBuilding’splanningpermission.
10.10TheTenantagreestoobtainaTVlicencebeforewatchingorrecordingprogrammesastheyarebeingshownontelevision,orliveonanonlinetelevisionservice,orbeforedownloadingorwatchingBBCprogrammesoniPlayeronanydevice(includinglaptop,mobilephone,tabletorgamesconsole)intheBuilding,exceptfordevicesprovidedbyandlicensedbytheLandlord.
11Attheendofthetenancy
11.1TheTenantmustvacatetheRoomandleaveitandtheContentsinitclean,tidy,andinnoworsecondition(exceptforfairwearandtearanddamagebyaninsuredrisk)thantheywereinatthestartoftheTenancyPeriod.ContentsmustbeleftinapproximatelythesamepositionsastheywereinatthestartoftheTenancyPeriod.
11.2TheTenantmust,jointlywithothersentitledtousethem,leavetheSharedAreasandsharedContentsintheFlatclean,tidy,andinnoworsecondition(exceptforfairwearandtearanddamagebyaninsuredrisk)thantheywereinatthestartoftheTenancyPeriod(thisclausedoesnotapplytostudios).ContentsmustbeleftinapproximatelythesamepositionsastheywereinatthestartoftheTenancyPeriod.
11.3TheTenantmustremovealltheirpersonalbelongingsfromtheBuildinganddepositanyrubbishinthereceptaclesdesignatedforthatpurpose.
11.4TheTenantmustreturntotheAgentalltheKeysthatwereissuedtotheTenant.
11.5IfanyitemotherthantheContentsisleftintheRoomorFlatattheendofthetenancytheAgentwillremoveitand(unlessofobviousvalue)willdisposeofitastheAgentthinksfitwithoutliabilitytotheTenantortheowneroftheitem.ThereasonablecostsofremovalandstoragemaybeclaimedasDamages.Ifanitemisobviouslyworthatleast£50andappearslikelytohavebeenleftbehindbymistake,theAgentwillusereasonableendeavourstocontacttheTenanttoarrangecollection.IftheTenantrequirestheAgenttoarrangedeliveryofanitem,theTenantmustfirstagreetopaythedeliverychargesasDamages.
LANDLORD’SOBLIGATIONS
12Servicesandfacilitiesmanagement
12.1TheLandlordwillmaintaintheBuildingandContentsingoodrepairandproperworkingorderbutnothinginthisclause12requirestheLandlordtoremedyanydamagecausedbytheTenantunlessthecostismetbytheTenantorbyinsurance.
12.2TheLandlordwillprovidethethingslistedinclause4.1ofthesetermsandconditions.
12.3TheLandlordandtheAgentwillnotunreasonablyinterferewiththeTenant’sprivacyandwillgivetheTenantreasonableadvancenotice(atleast24hours)beforeenteringtheRoomortheFlatforthepurposeofinspectionsorviewings,and7days’noticebeforecarryingoutplannedmaintenance,butnoadvancenoticewillbegiven:12.3.1inanemergency;or
12.3.2ifenteringforthepurposeofcarryingoutarepairrequestedbytheTenant;
12.3.3ifenteringtoabateanuisance;or
12.3.4wheretherearereasonablegroundstosuspectthattheTenantoranyoneforwhomtheTenantisresponsibleisengaginginunlawfulbehaviour,orisinseriousorpersistentbreachofthesetermsandconditionsinawaythatislikelytohaveanadverseeffectonotherresidents,theLandlord,orpeopleworkingfortheAgent.
13Policycompliance
13.1TheLandlordwilltakepropercareoftheTenant’sandtheGuarantor’spersonaldataandwillonlyprocesspersonaldata:13.1.1withthedatasubject’sconsentoratthedatasubject’srequest;
13.1.2totheextentnecessaryinordertoperformthetenancyagreement;
13.1.3inordertocomplywithlegalobligations;
13.1.4totheextentnecessarytoprotectthevitalinterestsofaperson(alifeordeathsituation);
13.1.5forthepurposesofperformingataskinthepublicinterest,suchasprovidinganonymiseddatatotheAgent’saccreditationbody;or
13.1.6forotherlegitimateobjectives,suchasaskingtheTenanttoparticipateinsatisfactionsurveys,enforcingtheLandlord’srightsandtheTenant’sobligationsinthetenancyagreementorforenforcingtheGuarantor’sobligations,andforthepurposesofdelegatingmanagementoftheBuildingtotheAgent.
13.2TheLandlordwillcomplywiththeAgent’sPrivacyPolicyaspublishedontheAgent’swebsite(printedcopyavailablefromtheAgentonrequest).
13.3TheLandlordandtheAgentwillaimtoprovideasafe,welcoming,supportiveenvironmenttoallresidents,ensuringthatnobodyreceiveslessfavourabletreatment,directlyorindirectly,onthegroundsofage,race,gender,religion,disability,sexualorientationormarital/parentalstatus.AcopyoftheapplicableEqualityandDiversityPolicyisavailablefromtheAgentuponrequestandtheLandlordagreestocomplywiththatPolicy.
14Roominspections
TheAgent’sstaffwillnotifytheTenantofthedateandtimeofroutineinspectionsandtheend-of-tenancyinspectionoftheRoomand(ifapplicable)theFlatandwillinvitetheTenanttoattend.
RELOCATION
15AttheTenant’srequest15.1TheTenantmayapplytotheAgentforaroomtransferwithintheBuilding.ApplicationsmustbemadeinwritingontheAgent’sstandardform,availablefromthePropertyManager’soffice.
15.2ApprovalofapplicationsfortransfersisatthePropertyManager’sdiscretionandsubjecttotherebeingasuitableroomavailable.
15.3TenantsapprovedfortransfermustpaytheAgentafeeof£100+VATtocovertheAgent’scostsofarrangingthetransfer.Thereisnochargeforunsuccessfultransferapplications.
16AttheLandlord’srequest
16.1TheLandlordmayasktheTenanttomovetoadifferentRoomintheBuildingif:16.1.1theTenantoccupiesanadaptedroom,whichtheTenantdoesnotneed,butwhichisneededforanotheroccupier;
16.1.2FlatsintheBuildingareunder-occupied;
16.1.3theLandlordhasreceivedarequestfromfriendswhowishtoliveinthesameFlat;
16.1.4theTenantisinseriousbreachoftheTenant’sobligations;
16.1.5theoccupiersofaFlatarenotlivingtogetherharmoniously;
16.1.6workneedstobecarriedoutintheRoomortheFlatanditisnotreasonablypracticabletopostponetheworkuntiltheendofthetenancy,ortocarryitoutwhilsttheTenantisinoccupation;or
16.1.7foranyothersubstantialoperationalreason.
17Intheeventofdamagebyaninsuredrisk
17.1TheLandlordhasthediscretionwhetherornottoinsureitselfagainstlossofrentintheeventoftheBuildingbeingdamagedordestroyedbyaninsuredrisk.
17.2IftheBuildingisdamagedbyaninsuredriskinawaythatmakestheRoomunfitforhabitation,theLandlordwillusereasonableendeavourstoprovidetheTenantwithalternativeaccommodationofasimilarstandardatnoextracost,untiltheRoomisonceagainfitforbeneficialoccupationanduse.IftheLandlordmakessuchaccommodationavailable,theTenantmustacceptit,andcontinuetopaytheRent.ThesetermsandconditionsandtheGuarantor’sguaranteewillthenapplytothesubstitutedaccommodationwhilsttheTenantoccupiesit.
17.3IfthesubstitutedaccommodationisnormallyletatalowerpricethantheRoom,theLandlordwillrefundthedifferencetotheTenant(whichmaybebywayofareductioninthelastinstalmentofRent).
17.4WheretheLandlordhasprovidedalternativeaccommodationanditisreasonablypracticabletoreinstatetheRoombeforetheendoftheTenancyPeriod:
17.4.1theLandlordwilltakeallreasonablestepstoarrangeforanydamagecausedbyaninsuredrisktoberemediedassoonaspracticable;and
17.4.2theTenantwillresumeoccupationoftheRoomassoonastheAgentrequiresafterthedamagehasbeenremedied.
17.5IftheLandlordisnotable(despiteusingreasonableefforts)tooffertheTenantalternativeaccommodationintheeventofaninsuredriskmakingtheRoomunfitforhabitation,theTenantmay:17.5.1maketheirownarrangementsforalternativeaccommodationuntiltheRoomisoncemorefitforhabitationandthenmovebackintotheRoomiftheAgentnotifiestheTenantthattheRoomhasbeenreinstatedbeforetheendoftheTenancyPeriod;or
17.5.2iftheLandlordhasnotreinstatedtheRoomorofferedtheTenantasuitablealternativebytheendof4weeksafterthedamage,theTenantmayterminatethetenancyagreementbygivingnoticetotheAgenttothateffect.Thenoticemustnotbegivenuntilatleast4weeksafterthedamagebutitmustbegivenbeforetheRoomhasbeenreinstatedoranalternativeofferedtotheTenant.
17.6TheLandlordwillrefundtotheTenantanyRenttheTenanthaspaidinrespectofanyperiodforwhichtheRoomisuninhabitableorinaccessibleasaresultofthedamage(butexcludinganyperiodforwhichtheLandlordhasofferedorprovidedtemporaryaccommodation).
17.7TheLandlordshallnotbeliabletotheTenantforremovalortravelexpenses,personalinjuryordamagetotheTenant’spossessionsunlesstheinsuredriskwasattributabletotheLandlord’snegligence.
17.8TheLandlordhasnoobligationtotheTenantunderthisclause17iftheinsurersrefusetopayoutonthepolicybecauseofanythingtheTenanthasdoneorfailedtodoinbreachoftheTenant’sobligationsinthesetermsandconditions,andinsuchcasetheTenantshallbeliabletoobserveandperformtheTenant’sobligations(includingtheobligationtopayRent)throughouttheTenancyPeriodtotheextenttheymaysafelydoso,havingregardtotheconditionoftheBuilding.
18Allrelocations
Ifrelocating,theTenantmustcomplywithclauses11.1and11.4withrespecttotheRoomtheyarevacating,andremovealltheirpersonalpossessionsandrubbishfromthatRoomatthetimeoftherelocation.
CANCELLATIONANDEARLYTERMINATION
19General19.1ThetenancyagreementisforatenancythatisintendedtolastforthefullTenancyPeriod.
19.2TheTenantdoesnothavethebenefitofany“cooling-off”period.Oncethetenancyagreementhasbeenconcluded(signedbythepartiesanddatedbyoronbehalfoftheLandlord,orbycompletionoftheBookingProcessandgenerationoftheConfirmation)itislegallybindingontheparties.Onceconcluded,thetenancyagreementcanonlybecancelledorterminatedassetoutinthesetermsandconditions,oraspermittedunderthegenerallawforbreachofafundamentalobligation.
19.3WheretheBuildingisdamagedbyanuninsuredriskandisnotreasonablyfitforhabitation,eitherpartymayterminatethetenancyagreementbygivingwrittennoticetotheother.TheLandlordwillrefundtotheTenantanyRenttheTenanthaspaidinrespectofanyperiodaftertermination.
20TerminationbytheLandlord
20.1IfanyofGrounds2,7A,7B,8,10-15,and17setoutinSchedule2oftheHousingAct1988(availabletoviewatwww.legislation.gov.uk)applyatanytimeorifGround9appliesatanytimeaftertheTenancyPeriodhasendedthen,subjecttoclauses20.2and20.4,theLandlordshallbeentitledtoendthetenancyagreementbyforfeitureorre-entryorbyservingnoticeundersection8oftheHousingAct1988.
20.2Ifgroundsforpossession(aslistedinclause20.1)exist,andtheLandlordissatisfied(actingreasonablyandobjectively)thattheTenanthasceasedtoresideintheRoomandthereisno-oneelselawfullyresidingintheRoom,theLandlordmay(butisnotunderanyobligationto)takepossessionoftheRoomandonthedatetheLandlorddoessothetenancywillterminate.
20.3IftheRoomhastwobeds,theLandlordshallbeentitledtoendthetenancyagreementbyforfeitureorre-entryorservingnoticeofterminationontheTenantiftheTenantisinseriousorpersistentbreachofthesetermsandconditions.
20.4WhilstthereisanyonelawfullyresidingintheRoomtheLandlordshallnotenforceitsrighttorecoverpossessionoftheRoomagainsttheoccupier,otherwisethanbyproceedingsinthecourtand(unlesstheLandlordacceptsasurrenderofthetenancy)thetenancyshallcontinueuntil:20.4.1theLandlordobtainsanorderofthecourtforpossessionoftheRoom;and
20.4.2thatorderhasbeenlawfullyexecutedbyanauthorisedperson(suchasacountycourtbailifforHighCourtEnforcementOfficer).
20.5IftheTenanthasnottakenpossessionoftheRoomorprovidedevidenceoftheTenant’sidentitythatisreasonablysatisfactorytotheAgentwithin7daysofthestartoftheTenancyPeriod,theAgentmay(buthasnoobligationto)advertisetheRoomasavailabletoletoroffertheRoomtoapersononitswaitinglist.IfasuitablereplacementoccupieristhenfoundbeforetheTenanttakespossession,theLandlordmayterminatethetenancyagreementimmediatelybygivingwrittennoticetotheTenanttothateffect.IftheLandlorddoesterminatethetenancyagreementinthisway,theTenantmustpaytheLandlord:20.5.1Rentfortheperioduptoandincludingthedateoftermination;and
20.5.2theAgent’sfeesforre-advertising,findingareplacementoccupierandarranginganewtenancyagreement
20.6IfduringtheTenancyPeriodtheRoomorFlatisdamagedbyaninsuredrisksoastobeuninhabitableorinaccessibletheLandlordwillusereasonableendeavourstoprovidetheTenantwithreasonablysuitablealternativeaccommodation,butiftheyareunabletoprocurebutifanyRentalreadypaidbytheTenantexceedsthosesumstheLandlordwillre-paythesurplustotheTenantwithin28daysofgivingnotice.18

21TerminationbytheTenant
21.1IftheTenantdoesnottakeupoccupationoftheRoom,oriftheTenantvacatestheRoombeforetheendoftheTenancyPeriod,thatalonewillnotterminatethetenancyagreement.
21.2TheLandlordisundernoobligationtoagreetoarequestforearlyterminationfromtheTenant.IftheTenantwishestoendthetenancyagreementbeforetheTenancyPeriodexpires,theTenantmustapplyinwritingtothePropertyManager’soffice,statingwhentheTenantwishestoendtheirtenancy.
21.3OnreceivinganapplicationforearlyterminationfromtheTenant,theAgentwillreviewitswaitinglistand,ifnecessary,advertisetheRoomasavailabletolet.
21.4IfasuitablereplacementtenantagreestotakeatenancyoftheRoomattheRentfortheremainderoftheTenancyPeriod,theLandlordwillagreetoendthetenancyagreementPROVIDEDTHAT:21.4.1theTenanthascompliedwithclauses11.1,11.3and11.4;
21.4.2thereplacementtenanthasenteredintoatenancyagreementandprocuredaguarantor(orpaidtheRentinfullinadvance);
21.4.3theTenanthaspaidRentandanydefaultchargesorDamagesthataccrueduptothedateoftermination;
21.4.4theTenantpaysafeeof£100+VATonaccountoftheAgent’scostsforarranginganearlyterminationofthetenancy(oragreesitmaybedeductedfromanyRentthatisduetoberefundedtotheTenant).
21.5Ifthetenancyagreementorthetenancyisterminatedunderthisclause21,theLandlordshallbeentitledtodeductanyoutstandingearlyterminationfees,DamagesanddefaultchargesbeforerefundingtotheTenantanypre-paidRentrelatingtotheperiodafterterminationofthetenancyagreement.
21.6IftheTenantterminatesthetenancyagreementorthetenancyaspermittedbythisclause21,theTenantshallremainliablefortheTenant’sobligationsthataccrueduptoandincludingthedateoftermination.
21.7Thisclause21doesnotapplywhentheRoomhasbeenbadlydamagedbyaninsuredrisk,theLandlordunableisprovidealternativeaccommodationfortheTenantandtheTenantterminatesthetenancyagreementunderclause17.5.
MISCELLANEOUS
22Landlord’sTrusteeStatus
22.1Thisclause22appliesonlyiftheBuildingisTheMetalworks,TheApolloWorks,HopeStreetApartments,TheOldDairyorFrobisherHouse.
22.2TheLandlordentersintothetenancyagreementasnominee(s)fortheunittrustnamedintheConfirmation.
22.3TheLandlord’sliabilityunderthetenancyagreementislimitedtoassetsheldbytheLandlordfromtimetotimeonbehalfoftheunittrust.
22.4TheLandlord(andifthereismorethanonepersonororganisationnamedasLandlord,noneofthem)hasnoobligationtomeetanyclaimorliabilityunderthetenancyagreementexcepttotheextentthattheycanproperlymeetsuchclaimorliabilityoutoftheassetsoftheunittrust.
22.5UnlessanduntiltheLandlordgivestheTenantand/ortheGuarantornoticetothecontrarytheLandlord’saddressforservice(includingtheserviceoflegalproceedings)shallbeasstatedontheConfirmation.
22.6TheConfirmationmaysetoutclausessimilarineffecttothisclause,butusingtheLandlord’sprescribedwording,andinthatcasethewordingintheConfirmationshallprevail.
23Notices
23.1AnynoticegivenbyoronbehalfoftheLandlordorTenantorGuarantormustbeinwriting.
23.2Unlessclause22applies,theLandlord’saddressinEnglandandWalesatwhichnotices(includingnoticesinproceedings)maybeservedonhimbytheTenantistheaddressoftheBuildingasgivenontheAgent’swebsiteandintheConfirmation.TheAgentwillnotifytheTenantinwritingifthereisanychangetothataddress.
23.3Anoticeandanyproceedingsshallbedeemedtobeservedontheintendedrecipientifdeliveredbyhandorsentbyfirstclasspost:23.3.1TotheLandlordortheAgentattheBuilding;
23.3.2TotheTenantattheRoom;
23.3.3TotheGuarantorattheGuarantor’saddressgivenintheguaranteeagreement
23.4Noticesotherthanproceedingsshallbedeemedtobeservedontheintendedrecipientifsentbyemailtothatparty’semailaddressasgivenduringtheBookingProcess,statedintheguaranteeagreement,orassubsequentlynotifiedtothesenderasbeingtheiremailaddressforthepurposeofservingnotices.
23.5Proceedingsmayonlybeservedbyemailiftheintendedrecipientfirstconfirmsinwritingtothesenderthatproceedingsmaybeservedbyemail,andspecifiestheemailaddressatwhichtheymaybeserved.
23.6Noticesdeliveredbyhandareservedondelivery;noticessentbyfirst-clastpostareservedontheseconddayafter(butnotincluding)posting;noticessentbyemailareservedonthedayofsendingifsentbefore3.00pmonaworkingdayandonthenextworkingdayaftersendingiftheemailissentatanyothertime.A‘’workingday’meansMondaytoFriday,butexcludesanydaythatisapublicholidayintheUK.

24Disclaimer
24.1UnlesscausedbytheLandlord’sortheAgent’snegligence,neithertheLandlordnortheAgentshallbeliablefor:
24.1.1anyfailure
24.1.2deathorpersonalinjury;
24.1.3damagetoorlossofproperty;
24.1.4theactionsorneglectofotheroccupiersintheBuilding.
24.2Nothinginclause24.1excludesliabilityforfraudorrecklessness.
25ProcedurefordealingwithBreachofTenant’sObligations
25.1WherecleaningisrequiredinordertorectifyabreachoftheTenant’sobligations,theAgentwillwritetotheTenantexplainingwhatisrequiredandgivetheTenantareasonableopportunitytodothecleaning.IfthecleaningisnotdonetoasatisfactorystandardbytheAgent’sstateddeadline,theAgentwillarrangeforthecleaningtobedone,andtheLandlordwillclaimthecostfromtheTenantasDamages.
25.2WherebreachoftheTenant’sobligationscausestheLandlordortheAgenttosufferlossorincurexpenditure,theLandlordortheAgentwillnotifytheTenantofanyamountclaimedasadefaultchargeorinDamagesandasktheTenanttomakepaymentwithin14days.
25.3IftheTenantdisputestheclaim,theTenantmayputtheircaseinwritingtothePropertyManager.TheLandlordortheAgentwillreviewtheclaim,decidewhethertomodifyit,notifytheTenantofthedecisionandgivetheTenantduewarningbeforebeginningaclaimincourt.
25.4IftheTenantrepeatedlyfailstocomplywiththeTenant’sobligations,theAgentmaynotifytheGuarantorand/ortheTenant’semergencycontactperson,astheTenant’sbehaviourmayaffecttheamounttheGuarantorisaskedtopay,and/orraiseconcernsabouttheTenant’swelfare.
25.5IftheTenant’sfailuretocomplywiththeTenant’sobligationsiscausingdisruptionornuisancetootheroccupiers,theAgentmayasktheTenanttorelocate(asanalternativetotheLandlordstartingpossessionproceedings).
25.6IftheTenantisinseriousbreachoftheTenant’sobligations,orinpersistentbreachwhichtheTenantfailstoremedyafterduewarning,theLandlordmaytakeproceedingsforpossessionagainsttheTenantand/orseekaninjunctiontopreventtheTenantenteringtheBuildingortomaketheTenant’spresenceattheBuildingsubjecttoconditionsimposedbythecourt.
26NoticeofMortgage
26.1TheLandlordherebygivesnoticetotheTenantthatpossessionoftheRoommightberecoveredunderGround2ofSchedule2oftheHousingAct1988because:26.1.1theBuildingissubjecttoamortgagegrantedbeforethebeginningofthetenancy;
26.1.2themortgageeisentitledtoexerciseapowerofsaleconferredonhimbythemortgageorbysection101oftheLawofPropertyAct1925;and
26.1.3themortgageewillrequirepossessionoftheRoomforthepurposeofdisposingoftheBuildingwithvacantpossessionifthatpowerofsaleisexercised.
27Governinglaw
Thetenancyagreementandanydisputeorclaimarisingoutof,orinconnectionwith,it,itssubjectmatterorformation(includingnon-contractualdisputesorclaims)shallbegovernedby,andconstruedinaccordancewith,thelawsofEngland.
28Jurisdiction
ThepartiesirrevocablyagreethatthecourtsofEnglandshallhavejurisdictiontosettleanydisputeorclaimarisingoutof,orinconnectionwith,thetenancyagreement,itssubjectmatterorformation(includingnon-contractualdisputesorclaims).
29Thirdparties
NothinginthetenancyagreementisintendedtoconferanyrightsonanypersonpursuanttotheContracts(RightsofThirdParties)Act1999otherthantheAgent.
30EntireAgreement
Thetenancyagreementincorporatesthepre-tenancyinformationabouttheBuildinggivenontheAgent’swebsite,theTenant’sselectionsmadeduringtheBookingProcess,thesetermsandconditions,theAgent’spoliciesreferredtointhesetermsandconditionsandthetermsandconditionsapplicabletothepersonalpossessionsinsuranceincludedintheRent.ThepartiesacknowledgethattheseitemscontainallthetermsagreedbetweenthemregardingatenancyoftheRoomfortheTenancyPeriod.

ThesetenancybookingtermsandconditionssetoutthetermsandconditionswhichapplytoyourbookingwithiQStudentAccommodation.IfyoudonotunderstandthesetermsandconditionsortheTenancyAgreementyoushouldseekappropriateadvicebeforeacceptingthem.
PaymentoftheBookingFeeconstitutesyouracceptancethattheBookingFeeisretainedtosecureyourroominaccordancewiththesetermsandconditions.YouagreebypayingusasaholdingdepositthatthedeadlinetoconcludetheTenancyAgreementfollowingreceiptoftheBookingFeeshallbe7daysthereafter,oranyotherperiodagreedtobyus(the“Deadline”).AsagreedbyenteringintotheTenancyAgreement,theBookingFeewillbetreatedasapaymenttowardsyourfirstrentalpaymentandcreditedtoyourrentaccount.
ByyoupayingtheBookingFee,yougiveusexpressconsenttousethedetailsprovidedbyyoutoundertakesearchesagainstsanctionlistsmaintainedbythegovernmentsof(a)theUnitedKingdom;(b)theUnitedStatesand(c)othercountriesaswechooseincludingthosemaintainedbytheUnitedKingdomTreasuryandtheUnitedStatesOfficeofForeignAssetsControl.Thiswillnotaffectyourrightsand/orourobligationstoyouundertheDataProtectionAct2018.

YoumaycancelyourbookingorTenancyAgreementwithussubjecttothecancellationpolicydetailedbelow.
PeriodbeforeyouenterintotheTenancyAgreement-FailuretocompleteyourapplicationandenterintotheTenancyAgreementbytheDeadline
iQStudentAccommodationreservestherighttonotreturntheBookingFeeandcancelyourbookingonnoticeif:(i)younotifyusaftertheDeadlinethatyouhavedecidednottoenterintotheTenancyAgreement;(ii)wetakeallreasonablestepstoenterintotheTenancyAgreementbeforetheDeadlineandyoufailtodoso,forexample,ifyoufailtocompleteyourapplicationorprovideguarantordetailsandsupportingdocumentationingoodtime;(iii)youprovideuswithrelevantfalseormisleadinginformation;and/or(iv)weareprohibitedfromenteringtotheTenancyAgreementbecauseoftheImmigrationAct2014(personsdisqualifiedbyimmigrationstatus).Fromthedateofcancellation,youwillnotbeliableforthecontractualobligationslaidoutintheTenancyAgreement,irrespectiveofwhetheryouhavesignedit.

IfyouenterintotheTenancyAgreement,andyouthenfailtocollectyourkeywithin5weeksoftheTenancyStartDate,iQStudentAccommodationreservestherightto:(a)cancelyourbookingandterminatetheTenancyAgreementand(b)re-letyourroom.Inthesecircumstancesanyrentpaidbyyou(includingtheBookingFeeallocatedtothefirstpaymentofrent)willnotberefundedtocoveranylossesincurredbyusforemptyunletrooms.ThisprovisiontakesprecedenceoveranyprovisionsintheTenancyAgreement.
Provisionoffalseormisleadinginformation,personsdisqualifiedbyimmigrationstatusorfailuretocompleteyourapplication,provideguarantordetailsorsupportingdocumentationingoodtime
WemayalsoterminateyourTenancyAgreementforanyofthereasonssetoutabove,assetoutinmoredetailinclause2.4oftheTenancyAgreementitself.
IfyouhaveenteredintotheTenancyAgreementandyouwishtocancelyourbooking,regardlessofwhetheryouhavecollectedyourkeys,youwillremainliableforthecontractualobligationssetoutintheTenancyAgreementandyoumaynotcancelthebookingunlessyoucanprovideproofthatyoufitanyofthefollowingcriteria:

IfyoufailtoobtainaUKVisabeforethestartdateofyourtenancy,wewillcancelyourTenancyAgreementandrefundanyrentpaymentsmadesolongasyouprovidethefollowinginformation:Writtenconfirmationfromyouthatyouwishtocancelyourreservation;andSupportingofficialevidencetoshowthattheVisawasdeclined.
ThissupportingevidenceshouldbesuppliedtoiQStudentAccommodationwithin72hoursofyoureceivingofficialconfirmation.Inthesecircumstances,yourBookingFeeandanyrentpaidwillbereturnedtoyouwithin4weeks.
Wherethereasonforcancellationisnotoneofthefourmatterslistedabove,youwillremainliableforthefullcontractualrent,unlessanduntilareplacementtenantisfoundforyouraccommodation.Youareresponsibleforfindinganeligiblereplacementtenant,althoughsitestaffwillassistwherepossible.

RoommovesafteryourTenancyStartDatewillbemanagedbasedonavailability.Anadministrationfeeof£50willbechargedforthevariationtotheTenancyAgreement.
Ifyouwishtochangeyourtenancylengthtooneoftheotheroptionsavailableatyourchosensite,youareabletodosowithoutrestrictionandwithoutchargeupuntil31stJuly(subjecttoroomavailability).
AfterthisdateyouwillbeunabletoshortenyourtenancylengthbutyoumaychoosetoextenditwithoutchargeupuntiltheTenancyStartDate(subjecttoroomavailability).Anadministrationfeeof£50willbepayableshouldyouwishtovaryyourTenancyAgreementtoonewithalongertenancylength(subjecttoroomavailability).

AccommodationOfficemeanstheaccommodationofficefortheLocation,asdetailedintheParticulars;
ApplicationmeansyourapplicationforaReservation;
BookingConfirmationmeanstheemailsentbyustoyouconfirmingyourRoom,theDuration,theResidenceFee,yourPaymentScheduleandyouracceptanceoftheseBookingTermsandConditions;
BookingTermsandConditionsmeanstogethertheseBookingTermsandConditions(includingtheSchedulesandannexesthereto),ourroomrates,privacypolicyandresidentpolicies(allofwhichareavailableontheWebsiteandmaychangefromtimetotime),andanyothertermsandconditionswebringtoyourattentionbeforetheBookingConfirmation;
Check-InDatemeansthedateonwhichyoucheck-intotheLocation,whichmaybedifferentfromtheStartDate;
Cooling-OffPeriodmeansfourteen(14)daysaftertheInitialPaymenthasbeenmadeandaBookingConfirmationhasbeenrecieved;
Depositmeans£250.00,beingapaymentwerequirefromyoutocoveranydamagetoourpropertyand/oroutstandingfeesorcosts,whichwillbeheldinaccordancewithparagraph6.4(Depositandcompensationforbreaches)oftheResidenceAgreement;
DetailsListmeansthedetailslistSchedule1(DetailsList)confirmingthetelephonenumber,email,addressandbankdetailsforeachLocation;
DurationmeanstheperiodfromtheStartDatetotheEndDateinclusive;
EndDatemeansthedateonwhichyoumustvacatetheRoom,asdetailedintheParticulars;
InitialPaymentmeansthe(non-refundable)initialportionoftheResidenceFeeweaskyoutopayinordertoreceiveaBookingConfirmation,asdetailedInthePaymentSchedule,whichformspartoftheResidenceFee;
InstalmentmeansanyoftheinstalmentsoutlinedinthePaymentSchedule,andInstalmentsmeansallofthem;
LateApplicationmeansanApplicationsubmittedintheperiodofuptothirty(30)calendardaysbeforetheStartDate;
LocationmeansthesiteatwhichtheRoomislocated(beingeitherourScapeMileEnd,ScapeGreenwich,ScapeShoreditch,ScapeGuildford,ScapeWembley,ScapeBloomsbury,ScapeMileEndCanalside,ScapeBrightonThePad(managedbyScape),Podium(managedbyScape)site),asspecifiedintheParticulars;
ParticularsmeanstheparticularsoutlinedinSchedule3(TheParticulars)whichlistthedetailsspecifictoyourReservation;
PaymentSchedulemeanstheagreedpaymentscheduleoutlinedintheParticulars;
RefundPolicymeansourrefundpolicyavailableontheWebsitewhichoutlinesyourentitlementtoarefund;
ReservationmeansyourreservationforaRoomatourScapeMileEnd,ScapeGreenwich,ScapeGuildford,ScapeWembley,ScapeBloomsbury,ScapeShoreditch,ScapeMileEndCanalside,ScapeBrighton,ThePad(managedbyScape)andPodium(managedbyScape)site;
ResidenceAgreementmeansthelegalagreementrelatingtoyouroccupancyoftheRoomatLocation,asdetailedinSchedule2(ResidenceAgreement);
ResidenceFeemeanstheamountyouhaveagreedtopayfortheRoomfortheDuration,payableinaccordancewiththeInitialPaymentandtheInstalments,asdetailedinthePaymentSchedule;
RequiredDocumentationmeansthefollowingdocumentationwhichyoumustprovidebeforewecanacceptyouasaresidentontheCheck-InDate:
1.acopyofyourpassportorgovernment-issuedIDorotherformofidentification(e.g.NationalInsurancenumber)and,ifrequiredtoentertheUK,avalidvisastamp;and
2.yourUCASorotherstudentIDnumberverifyingthatyouhavebeenacceptedonacourseofstudy;
RoommeanstheroomattheLocationwhichyouarecontractingfor,asdetailedintheParticulars;
StartDatemeansthedatefromwhichyouareentitledtostartusingtheRoom,asdetailedintheParticulars;meansthedatefromwhichyouareentitledtostartusingtheRoom,asdetailedintheParticulars;
"we"or"us"meanseither:
1.GCPScapeEastLtd,tradingas“ScapeMileEnd”ifyourRoomisatourScapeMileEndsite;
2.LeopardGuernseyGreenwich2Limited,tradingas"ScapeGreenwich"ifyourRoomisatourScapeGreenwichsite;
3.LeopardGuernseyOldStreet,tradingas"ScapeShoreditch"ifyourRoomisatourScapeShoreditchsite;
4.GCPSGLimitedtradingas“ScapeGuildford”ifyourRoomisatourScapeGuildfordsite;

"you"or"your"meansthepersonsubmittingtheReservationandenteringintotheResidenceAgreement.
1.2Interpretation
1.2.1.HeadingsusedintheseBookingTermsandConditionsareforconvenienceonlyandshallnotaffecttheinterpretationoftheseBookingTermsandConditions.
1.2.2.Unlessotherwisespecified,areferencetoaClauseoraScheduleistoaclauseinorascheduleto(andformingpartof)theseBookingTermsandConditions,andareferencetoaparagraphoranannexistoaparagraphoforanannextoaSchedule.
1.2.3.Areferencetoastatuteorstatutoryprovisionisareferencetoitasitisinforceforthetimebeing,takingaccountofanyamendment,extensionorre-enactmentandincludesanysubordinatelegislationmadepursuanttoit.
1.2.4.AnyreferencetotheLocationincludesareferencetotheRoom.
1.3.AnyterminationoftheseBookingTermsandConditionsshallnotaffectanypre-existingrightsofanypartyagainsttheother.
2.YOURSTATUSREQUIREMENTS
2.1.BymakingaReservationyouconfirmthatyouare18orolderandhavebeenacceptedonafull-timestudyprogramataLondonschool,collegeoruniversityfortheDuration.
2.2.Ifyouareunder18youmustinvolveaparentorguardianwhenmakingaReservation.
2.3.Fortheavoidanceofdoubt,youmustbe18orolderontheStartDate.
3.AVAILABILITY
3.1.AllReservationsaresubjecttoconfirmationofavailabilityandacceptancebyus.
3.2.Ifforanyreasontheroomtypeyourequestedisnolongeravailablewewillatourdiscretioneither:
3.2.1.offeryoualternative,suitableroomtype(wherethisispossible);or
3.2.2.declineyourrequestandaddyoutoourwaitinglist.
4.ACCEPTINGTHEBOOKINGTERMSANDCONDITIONS
4.1.YouacceptandagreetobeboundbytheseBookingTermsandConditions(includingtheResidenceAgreement)whenyousubmityourApplication.
4.2.BysubmittinganApplicationyouconfirmthatyouhavebeengivenanopportunitytoreadandunderstandtheseBookingTermsandConditions(includingtheResidenceAgreement)andagreetobeboundbythem.
4.3.PleaseensurethedetailsyouprovidewhenmakinganApplicationarecorrectandinformuspromptlyofanychangestothosedetails(e.g.changeofemailorpostaladdress).
5.BEFORECHECKING-IN
5.1.OnceyouhavesubmittedyourApplicationyoumustpaytheInitialPaymentbytheagreeddateoutlinedintheParticulars.
5.2.IfyousubmitaLateApplication,Clause5.1willbemodifiedsuchthattherewillbenoInitialPaymentandyouwillberequiredtopaythefirstInstalmentbytheagreeddateoutlinedintheParticulars.
Pleasenote:ifyoupaytheInitialPaymentand/orfirstInstalmentonlineviathesecurepaymentgateway,thesameaccountdetailswillbeusedtopaytheremainingInstalmentsoftheResidenceFee.Ifyouwishtoarrangeanalternativemethodofpayment,youmustlog-intoyouraccountwiththesecurepaymentgateway(setupwhentheInitialPaymentispaid)andchangethepaymentdetailsmanually.
5.3.WhenwehavereceivedyourInitialPaymentinaccordancewithClause5.1,oryourfirstInstalmentinaccordancewithClause5.2,andthepaymenthasbeencleared,wewillthensendyouaBookingConfirmation.
5.4.YoumustbringtheRequiredDocumentationontheCheck-InDate.
5.5.IfwedonotreceivetheInitialPayment(whereapplicable),thefirstInstalmentand/ortheRequiredDocumentationbythedaterequired,wemayatouroptioncancelyourReservationinaccordancewithClause7(Cancellations).
5.6.Youagreethatwewillnotbeliableforanyloss,expenseorinconveniencesufferedbyyoubecausewedonotprovideyouwithaRoombecauseofyourfailuretocomplywithyourobligationsinClauses5.1,5.2and/or5.4above.
6.CHECKING-IN
6.1.InadvanceontheCheck-InDateyouwillberequiredtopaytheDeposit.
6.2.Fortheavoidanceofdoubt,youwillnotbeentitledtousetheRoomunlessyouhave:
6.2.1.receivedaBookingConfirmation;
6.2.2.showedyourRequiredDocumentationonorpriortotheCheck-InDate;
6.2.3.paidthefirstInstalmentbytheagreeddateoutlinedintheParticulars;and
6.2.4.paidtheDeposit.
7.CANCELLATIONS
7.1.YoumaycancelyourReservationbynotifyingusinwritingbyemailtotheLocationemailaddressassetoutintheDetailsListatanytimewithintheCooling-OffPeriod.
7.2.IfyourStartDateisinadvanceoftheCooling-OffPeriodending,youagreethattheCooling-OffPeriodcancellationrights(referredtoinClause7.1above)willceaseontheStartDate.
7.3.IfyousubmitaLateReservationandyouwillbecheckinginbeforetheCooling-OffPeriodhasexpired,youagreethattheCooling-OffPeriodcancellationrightswillendontheCheck-InDate.
7.4.IfyoumakeacancellationinaccordancewithClause7.1above,youwillbeentitledtoarefundofanypaymentsmadeinaccordancewithourRefundPolicy.
7.5.WemayatouroptioncancelyourReservationandbringtheseBookingTermsandConditionstoanendifeitherofthefollowingoccur:
7.5.1.theinformationyouprovideaspartoftheReservationprocessturnsouttobefalse;or
7.5.2.youfailtocomplywithyourobligationsinClauses5.1,5.2,5.4and/or5.5(PriortoChecking-In).
7.6.WewillnotifyyoubyemailifwechoosetocancelyourReservationinaccordancewithClause
7.7.TheseBookingTermsandConditions(otherthantheRefundPolicy)willendandceasetohavelegalforceandeffectfromthedatewesendyouthisemailnotification.ThisrightofcancellationisseparatefromtherightofterminationcontainedintheResidenceAgreement.PleaseseeourRefundPolicyforanyrefundsyoumaybeentitledto.
7.8.WereservetherighttodeclineorcancelyourReservationotherthaninaccordancewithClause7.5.PleaseseeourRefundPolicyforanyrefundsyoumaybeentitledtoincircumstancessuchasthese.
8.GENERALTERMS
8.1.ByacceptingtheseBookingTermsandConditionsyou:
8.1.1.agreetonotifyusofanychangestoyourpersonalcircumstances(includingchangeofe-mailaddress,correspondenceaddressorphonenumber).Youacknowledgethatwewillnotbeliabletoyouifyoudonotreceiveacommunicationfromusbecauseyouhavefailedtoinformusofchangestoyourcontactdetails;
8.1.2.agreetoreceivecommunicationsfromuselectronicallyandthatelectroniccommunicationswillsatisfyanylegalrequirementforcommunicationstobeinwriting;
8.1.3.acknowledgethatifwedonotreceivetheInitialPaymentfromyoubytheagreeddateintheParticulars,wemaycancelyourReservationandtheseBookingTermsandConditionsandyouwillhavenoclaimagainstusasaresult;
8.1.4.acknowledgethatifwedonotreceivetheRequiredDocumentationpriortoyourCheck-InDatethenwemaycancelyourReservationandtheseBookingTermsandConditionsandyouwillhavenoclaimagainstusasaresult;
8.1.5.acknowledgethatifyouprovidefalseinformationaspartoftheReservationprocess,thenwemaycancelyourReservationandtheseBookingTermsandConditionsandyouwillhavenoclaimagainstusasaresult;
8.1.6.acknowledgethatifyoufailtopayanyInstalmentbythedateagreedinthePaymentSchedule,wemayexerciseourrightsundertheseBookingTermsandConditions;and
8.1.7.acknowledgethatifweterminateyourResidenceAgreementaftertheStartDateinaccordancewithparagraph6.1(Licensorsrighttoterminate)oftheResidenceAgreement,yourobligationtopayanyremainingInstalmentsoftheResidenceFeeshallcontinuenotwithstandingterminationoftheResidenceAgreement.
8.2.ByacceptingyourApplication,weagreetoacceptyouasaresidentsubjectto:
8.2.1.usreceivingtheInitialPaymentbeforetheStartDate(whereapplicable);
8.2.2.usreceivingyourpaymentofanyInstalmentsduebeforetheStartDate;
8.2.3.usreceivingyourRequiredDocumentationonorpriortotheCheck-InDate;
8.2.4.youfulfillingthestatusrequirementssetoutinClause2(YourStatusRequirements)ontheStartDate;and
8.2.5.youpayingtheDepositinadvanceoftheCheck-InDate.
9.PRIVACYANDCOMMUNICATIONS
9.1.Wecannotguaranteethesecurityofdatawhichyousendtousbyemail.Pleasedonotsenduspaymentdetailsusingemail.
9.2.We(andourappointedthirdpartyproviders)collectcertainpersonalinformation(e.g.name,address,emailaddress)aboutyou("PersonalInformation")whenyousubmitaReservation.FordetailsonhowweusePersonalInformation,pleasereadourprivacypolicyavailableontheWebsite.UnlesswearefraudulentornegligentwewillnotbeliabletoyouforanylossescausedasaresultofunauthorisedaccesstothisPersonalInformation.
9.3.Youareresponsibleforensuringtheemailaddressandothercontactdetailsyouprovidetousarecorrect.Wewillnotberesponsibleifyoudonotreceivecommunicationsfromusbecausethedetailsyouhavesuppliedareincorrectorintheeventoftelecommunicationsystemfailuresoutsideourcontrol.

10.LOSSES
10.1.WewillberesponsibleforanylossesyousufferasadirectresultofusbreachingtheseBookingTermsandConditionsifthoselosseswerereasonablyforeseeabletobothyouandusatthetimeBookingConfirmationisissued.Wewillnotberesponsibletoyouoranythirdpartyforanybusinessloss(includinglossofrevenue,profits,contracts,anticipatedsavings,wastedexpenditure,dataorgoodwill)oranyotherlossordamagewhichdoesnotresultdirectlyfromouractionsortheactionsofourappointedsub-contractorsoragents,orisconsequential.
10.2.OurliabilitytoyouundertheseBookingTermsandConditionswillnotexceedtheamountofanydeposits,feesorotherchargesyoupaytous.
10.3.NothingintheseBookingTermsandConditionsexcludesorlimitsourliabilitytoyouforpersonalinjuryordeathcausedbyournegligence.
11.EVENTSBEYONDOURREASONABLECONTROL
WewillnotberesponsibletoyouforanydelayorfailuretocomplywithourobligationsundertheseBookingTermsandConditionsifthedelayorfailurearisesfromanycausebeyondourreasonablecontrol(includingfailureoftelecommunicationlinks).
12.ROOMRATESANDCOSTS
12.1.Exceptincasesofobviouserrors,theroomratesandotheraccommodationcostswillbeasquotedontheWebsite(whichmaychangefromtimetotime).Weevaluateroomratesandotheraccommodationcostsperiodicallyandreservetherighttoupdateourratestoaccordtomarketconditions.RoomratesandothercostswillbebilledinaccordancewiththePaymentScheduleweagreewithyou.
12.2.AlthoughwetrytoensuretheroomratesandothercostspublishedonourWebsiteareaccurate,errorsmaysometimesoccurandwewillnotbeliableforanylossarisingasaresultofsucherrors.Formoreinformation,pleaseseeourWebsiteTermsandConditionsofUse(availableontheWebsite).
13.ALTERATIONSTOTHEWEBSITEANDTERMSANDCONDITIONSOFUSE

14.3.NothinginthisClause14shalllimitorexcludeanyliabilityforfraud.
15.WAIVER
IfyoubreachtheBookingTermsandConditionsandwetakenoactionwewillstillbeentitledtouseourrightsandremediesinothersituationswhereyouareinbreach.
16.THIRDPARTYRIGHTS
ApartywhichisnotapartytotheseBookingTermsandConditionsshallhavenorightstoenforceanytermsundertheContract(RightsofThirdParties)Act1999.

18.SEVERABILITY

20.2.Nopersonorgroupofpersonsapplyingforaccommodationwillbetreatedlessfavourablythananyotherpersonorgroupofpersonsbecauseoftheirrace,colour,ethnicornationalorigin,gender,disability,appearance,age,maritalstatus,sexualorientationorsocialstatus;
20.3.Staffwillbetrainedorwillhavesufficientknowledgeofequalityanddiversitypracticetoensurethatcommitmentstoequalitypoliciesarefulfilled;
20.4.Tenantsaremadeawareoftheorganisation’sequalityanddiversitypoliciesaspartoftheinformationprovidedtotenantsandpotentialtenantsinmarketingandtenantinformation;
20.5.Aspartofitscommitmenttoassistthosewithdisabilities,itisagreedthatchargesforroomsadaptedforusebystudentswithdisabilitiesshouldnotexceedthenormalroomrateforthatdevelopment.
21.FLEXIBLEPOLICIES
21.1.NoVisa.NoPay:ifthestudentdoesn’tgethis/hervisatocomeandstudyintheUK,thestudentmustemailthevisaapplicationrejectionletterwithin7daysofreceivingittorents.uk@scape.comandwewillcancelthebookingandrefundthemoneytothestudent.

22.1AreyouanRCSIStudentIfso,pleaserememberthatScapeworkscloselywithRCSItomakesureyouareallocatedintothecorrectlearningcommunities.ThismightresultinScapehavingtoreallocateyourroombookingbasedonRCSI'srecommendations.

YoucancancelyourbookinginwritingorbysendinganemaildirectlytothePropertyTeamwithin7daysofacceptingyourtenancyagreement.Ifyoudecidetocancelyouraccommodationbookingwithinthese7daysyouwillreceiveafullrefundofyourdeposit.Nofees,nofuss.
Ifyoudecidetocancelyourbookingafterthe7-daycooling-offperiod,thebelowprocedureswillapplydependingonyourcircumstances:

IfyousecureyouraccommodationandthenfortheabovereasonsarenolongerabletoattendtheaffiliatedUniversity,officialwrittenevidencefromtherelevantUniversityand/orSummerSchooland/orUCASand/orVISAauthorities/embassymustbesentdirectlytothePropertyTeamwithin3calendardaysoftheresultsordecisionbeingpublished.Ifsufficientevidenceisprovided,youwillbeeligibleforreleasefromthetenancyagreementandthefulldepositwillbereturned.
IfyousecureyouraccommodationandthenGovernmentimposedtravelrestrictionspreventyoufromtravellingtotheUKtotakeupyourplaceatuniversity,officialwrittenevidencefromtheUniversityconfirmingthatyouhavecancelledyourstudiesandwillnotbeenrolledasastudentattheUniversityforthe2021/22academicyearmustbesenttothePropertyTeambeforethetenancystartdate.Ifsufficientevidenceisprovided,youwillbeeligibleforreleasefromthetenancyagreementandthefulldepositwillbereturned.
Alternatively,youmayrequestthatthestartofyourtenancybeputbacktothefirstdayofthemonthinwhichtherestrictionsareliftedandyouareabletotraveltotheUK.PleasesubmityourrequesttothePropertyTeambeforethetenancystartdate.Ifsufficientevidenceisprovided,wewillchangeyourtenancystartdatetothefirstdayofthemonthinwhichthetravelrestrictionsarelifted.Wewillsendyouwrittenconfirmationofyournewtenancystartdate.Wewillalsoapplyacredittoyouraccountfortheaccommodationfeesfortheperiodfromyouroriginaltenancystartdatetothenewtenancystartdate.
IfyoudonotwishtoliveatStudentRoostfortheabovereasons,youwillberequiredtofindareplacementpersontotakeoveryourtenancy.Thereplacementpersonmustbeastudentandmatchthepreferencesoftheaccommodation(e.g.femaleonlyflat).Thereplacementpersonmustsignacontractfortheentirelengthofyourtenancyagreementandsecurethiswithpaymentofthedeposit.Ifareplacementpersonisfound,youwillbereleasedfromyourtenancyagreementfromthestartdateofthereplacementpersonstenancy,andStudentRoostwillreturnyourdepositinfull.Pleasenotethatyourdepositwillberetainedandyouwillremainliableforallaccommodationfeesuntilareplacementpersonisfound.
IfyouareanexistingStudentRoostcustomerwithavalid2020/21tenancyagreementandyousecureyouraccommodationforthe2021/22academicyearandthentheUniversitymovesyour2021/22coursefullyonlinewithnoface-to-faceteachingwhatsoever,youmaybeeligibletobereleasedfromyourtenancyforthe2021/22academicyear.OfficialwrittenevidencefromtheUniversityconfirmingthatyourstudieshavebeenmovedwhollyonlinemustbesenttothePropertyTeambefore1August2021.Ifsufficientevidenceisprovided,youwillbeeligibleforreleasefromthe2021/22tenancyagreementandthefulldepositwillbereturned.
B:BOOKINGSMADEONORAFTER1AUGUST2021
Ifyoubookyouraccommodationonorafter1August2021,yourcoolingoffperiodwillreduceto24hoursonlyfrompointofacceptance.Ifyoucancelyourbookingwithinthese24hours,yourfulldepositwillbereturned.Shouldyouwishtocancelafterthese24hours,theproceduresdetailedinsectionsAandCofthispolicywillapplydependingonyourcircumstances.
C:CANCELLATIONSFOLLOWINGTENANCYSTARTDATE
Shouldyouwishtocancelafteryourtenancyhasstartedthebelowprocedureswillapplydependingonyourcircumstances.
Ifyouareunabletocontinueyourstudiesatuniversityandwillnolongerbeauniversitystudent,youmaybeeligibletobereleasedfromyourtenancy.YourrequesttocancelmustbesubmitteddirectlytothePropertyTeaminwritingorviaemailandbeaccompaniedbyevidenceofyourwithdrawalfromuniversityandthereasonsbehindthis.
Ifyouaregrantedatenancyrelease,yourdepositwillbereturnedtoyou(minusanydeductionsrelatingtotheconditionoftheaccommodationuponyourdeparture).
Ifyouwanttocancelyourtenancyduetotheabovereasons,youwillberequiredtofindareplacementpersonfortheremainderofyourtenancyperiod.Thereplacementpersonmustsignacontractfortheremaininglengthofyourtenancyagreementandsecurethiswithpaymentofthedeposit.Thereplacementpersonmustbeastudentandmatchthepreferencesoftheaccommodation(e.g.femaleonlyflat).Ifareplacementpersonisfound,youwillbereleasedfromyourtenancyagreementfromthestartdateofthereplacementperson’stenancyandStudentRoostwillreturnyourdeposit(minusanydeductionsrelatingtotheconditionoftheaccommodationuponyourdeparture).Pleasenotethatyourdepositwillberetainedandyouwillremainliableforallaccommodationfeesuntilareplacementpersonisfound.
Illness
Ifyouwishtoleavetheaccommodationduetoillness,thiswillbeassessedonacase-by-casebasis.TherequesttocancelmustbemadeinwritingorviaemailtothePropertyTeamandanydocumentationsupportingthereasonsfortherequestmustalsobeprovided.Untiladecisionhasbeenmade,youwillremainliableforallaccommodationfees.Ifatenancyreleaseisnotgranted,youwillberequiredtofindareplacementpersonbeforeyouarereleasedfromyourtenancy.Ifyouaregrantedatenancyrelease,yourdepositwillbereturnedtoyou(minusanydeductionsrelatingtotheconditionoftheaccommodationuponyourdeparture)
