Article52Counterrevolutionariesshallbesentencedtodeprivationofpoliticalrightsasasupplementarypunishment;wherenecessary,criminalswhoseriouslyunderminepublicordermayalsobesentencedtodeprivationofpoliticalrightsasasupplementarypunishment.
Article55Confiscationofpropertyreferstotheconfiscationofpartorallofthepropertypersonallyownedbyacriminal.

Section1Sentencing
Article57Whensentencingacriminal,apunishmentshallbeimposedbasedonthefacts,natureandcircumstancesofthecrime,thedegreeofharmdonetosocietyandtherelevantprovisionsofthisLaw.
Article60Allpropertyillegallyobtainedbyacriminalshallberecovered,orcompensationshallbeordered.Contrabandsandpossessionsofthecriminalthatwereusedinthecrimeshallbeconfiscated.
Section2Recidivists
Forcriminalswhoareparoled,theperiodstipulatedintheprecedingparagraphshallbecountedfromthedatetheparoleexpires.
Article62Acounterrevolutionarywhocommitsanothercrimeofcounterrevolutionatanytimeafterservinghissentenceorreceivingapardonshallbedealtwithasarecidivist.

Ifamongthecrimesthereareanyforwhichasupplementarypunishmentisimposed,thesupplementarypunishmentmuststillbeexecuted.

Theprobationperiodforsuspensionoffixed-termimprisonmentshallbenotlessthanthetermoriginallydecidedandnotmorethanfiveyears,butitmaynotbelessthanoneyear.
Theprobationperiodforsuspensionofsentenceshallbecountedfromthedatethejudgmentismadefinal.
Article69Suspensionofsentenceshallnotbeappliedtocounterrevolutionarycriminalsorrecidivists.
Section6CommutationofPunishment
Article71Acriminalsentencedtopublicsurveillance,criminaldetention,fixed-termimprisonmentorlifeimprisonmentmayhavehispunishmentcommutedifheshowstruerepentanceorperformsmeritoriousservicewhileservinghissentence.However,afteroneormorecommutations,thetermofpunishmentactuallytobeservedbythosesentencedtopublicsurveillance,criminaldetentionorfixed-termimprisonmentmaynotbelessthanhalfofthetermoriginallydecided;forthosesentencedtolifeimprisonment,itmaynotbelessthantenyears.
Article72Atermoffixed-termimprisonmentthatiscommutedfromalifeimprisonmentshallbecountedfromthedatetheorderofcommutationisissued.
Section7Parole
Article74Theprobationperiodforparoleinthecaseofafixed-termimprisonmentshallbeequaltotheportionofthetermthathasnotbeencompleted;theprobationperiodforparoleinthecaseoflifeimprisonmentshallbetenyears.
Theprobationperiodforparoleshallbecountedfromthedatethecriminalisreleasedonparole.
Section8Limitation
(1)fiveyears,whenthemaximumprescribedpunishmentisfixed-termimprisonmentoflessthanfiveyears;(2)tenyears,whenthemaximumprescribedpunishmentisfixed-termimprisonmentofnotlessthanfiveyearsbutlessthantenyears;
(3)fifteenyears,whenthemaximumprescribedpunishmentisfixed-termimprisonmentofnotlessthantenyears;and
Article78Thelimitationperiodforprosecutionshallbecountedfromthedateofthecrime;ifthecriminalactisofacontinualorcontinuousnature,itshallbecountedfromthedatethecriminalactisterminated.
Iffurthercrimeiscommittedduringalimitationperiodforprosecution,thelimitationperiodforprosecutionoftheformercrimeshallbecountedfromthedatethelattercrimeiscommitted.

Whoeverleadsmembersofthearmedforces,thepeople'spoliceorthepeople'smilitiatodefecttotheenemyandturntraitorshallbesentencedtolifeimprisonmentorfixed-termimprisonmentofnotlessthantenyears.
Article95Ringleadersofanarmedmassrebellionorotherswhosecriminalinvolvementsareveryseriousshallbesentencedtolifeimprisonmentorfixed-termimprisonmentofnotmorethantenyears;otheractiveparticipantsshallbesentencedtofixed-termimprisonmentofnotlessthanthreeyearsandnotmorethantenyears.
Article96Ringleaderswhogatheragrouptoraidaprisonororganizeajailbreakorotherswhosecriminalinvolvementsareveryseriousshallbesentencedtolifeimprisonmentorfixed-termimprisonmentofnotlessthantenyears;otheractiveparticipantsshallbesentencedtofixed-termimprisonmentofnotlessthanthreeyearsandnotmorethantenyears.

Article100Whoever,forthepurposeofcounterrevolution,carriesonanyofthefollowingactsofsabotageshallbesentencedtolifeimprisonmentorfixed-termimprisonmentofnotlessthantenyearsor,ifthecircumstancesarerelativelyminor,tofixed-termimprisonmentofnotlessthanthreeyearsandnotmorethantenyears:
(1)causingexplosions,settingfires,breachingdikesandusingtechnicalorothermeanstosabotagemilitaryequipment,productionfacilities,communicationsortransportationequipment,constructionprojects,dangerpreventionequipmentorotherpublicstructuresorpublicproperty;
(2)stealingstaterecordsormilitarymaterialsorplunderingindustrialorminingenterprises,banks,shops,warehousesorotherpublicproperty;
(3)hijackingships,navalvessels,aircraft,trains,tramsormotorvehicles;
(4)directingtheenemytoanybombingorshellingtarget;and
(5)manufacturing,forciblyseizingorstealinggunsorammunition
