要旨[KeyPoints]
对性侵害未成年人犯罪要依法从严惩处。行为人实施线上猥亵犯罪行为后，又以散布私密照片、视频相要挟，强迫未成年被害人与其发生性关系的，构成两个独立的犯罪行为，应分别认定为猥亵儿童罪和强奸罪。办案中发现未成年被害人私密照片、视频在互联网传播扩散的，检察机关应当及时协调有关部门删除信息、阻断传播。检察机关要能动发挥法律监督职能，积极推动各方协同发力，共同加强未成年人网络保护。
Crimesofsexualassaultagainstminorsmustbeseverelypunishedinaccordancewiththelaw.If,aftercommittingthecriminalactofonlinemolestation,anactorforcessexualintercoursewiththeminorvictimbythreateningtodisseminateprivatephotosandvideos,theactorcommitstwoindependentcriminalactsandshallbedeterminedtohavecommittedchildmolestationandrape,respectively.WhenhandlingthecaseanddiscoveringthattheprivatephotosandvideosoftheminorvictimarebeingdisseminatedontheInternet,theprocuratorialorgansshallpromptlycoordinatetheeffortsofrelevantorganstodeletetheinformationandblockitsdissemination.Theprocuratorialorgansmustactivelyperformtheirlegalsupervisionfunctionsandpromotethecoordinatedeffortsofallpartiestojointlystrengthentheprotectionofminorsincyberspace.

办理涉及众多未成年人的网络诈骗案件，应注重罪错未成年人分级干预，实现分类处理，精准帮教。依托侦查监督与协作配合机制，建议公安机关在全面收集证据、查清事实基础上，充分考量未成年人的涉案情节，综合判定其主观违法性认识，依法分类处置。在审查起诉时，结合社会调查、心理测评、风险评估等情况，对涉罪未成年人进行分类处理并开展精准帮教。针对未成年人涉网违法犯罪防治难题，推动多部门搭建数字平台，实现对未成年人涉网违法犯罪的精准预防。

办理未成年人涉嫌使用本人银行卡帮助信息网络犯罪活动罪案件，应当结合涉案未成年人身心特点，重点审查是否明知他人利用信息网络实施上游犯罪并提供帮助。对于主观恶性不大、社会危害较小且自愿认罪认罚的未成年人，坚持以教育、挽救为主，符合附条件不起诉的，依法适用附条件不起诉。对于未成年人银行账户管理存在漏洞，有异常交易风险的，检察机关通过向金融监管机关、商业银行制发检察建议，强化账户源头管理，推动诉源治理。
Whenhandlingcriminalcasesinvolvingminorssuspectedofusingtheirownbankcardstoassistinformationnetworkcriminalactivities,theprocuratorialorgansshalltakeintoaccounttheminors'physicalandmentalcharacteristicsinassessingwhethertheseminorsprovideassistancewithknowledgethatanotherpersonisusingtheinformationnetworktocommitpredicatecrimes.Ifminorsexhibitslightmaliciousintent,poselittlesocialharm,andvoluntarilyadmitguiltandacceptpunishment,theprocuratorialorgansshallprioritizetheireducationandrehabilitation.Iftheminorsareeligible,theprocuratorialorgansshallapplyconditionalnon-prosecutioninaccordancewiththelaw.Ifminors'bankaccountsandriskofabnormaltransactionsismismanaged,theprocuratorialorgansshallenhancemanagementofaccountsatsourceandadvancethegovernanceoflitigationsourcesbyissuingprocuratorialproposalstothefinancialregulatoryorgansandcommercialbanks.

检察机关办理涉未成年人网络犯罪案件，应当注重审查刑事案件背后是否存在未成年人网络保护职责未落实的监督线索。检察机关发现互联网平台上存在向未成年人租售网络游戏账号的，可以依法督促行政监管部门履职，全面维护未成年人网络权益。发现未成年人因沉迷网络而遭受侵害的，应当同步落实被害修复与不良行为干预措施。检察机关应当促进法律监督与行政监管的配合协作，助推行政监管部门提升未成年人网络保护执法规范化水平。
