Article3TheStateCouncil，thatis，theCentralPeople'sGovernment，ofthePeople'sRepublicofChinashallconcludetreatiesandagreementswithforeignstates.
Article4ThePeople'sRepublicofChinashallconcludetreatiesandagreementswithotherstatesinthenameof：
（1）thePeople'sRepublicofChina；
（2）theGovernmentofthePeople'sRepublicofChina；
（3）thegovernmentaldepartmentsofthePeople'sRepublicofChina.
Article5Thedecisiontonegotiateandsigntreatiesandagreementsshallbemadeaccordingtothefollowingprocedures：
（1）inthecaseofatreatyoragreementtobenegotiatedandsignedinthenameofthePeople'sRepublicofChina，theMinistryofForeignAffairsorthedepartmentconcernedundertheStateCouncilinconjunctionwiththeMinistryofForeignAffairsshallmakearecommendationanddrawupadrafttreatyoragreementoftheChinesesideandsubmitittotheStateCouncilforexaminationanddecision；
Article6Representativesfornegotiatingandsigningtreatiesoragreementsshallbeappointedaccordingtothefollowingprocedures：
（2）InthecaseofanagreementtobeconcludedinthenameofagovernmentaldepartmentofthePeople'sRepublicofChina，arepresentativeshallbeappointedbytheheadofthedepartmentconcerned.
（1）thePremieroftheStateCouncil，theMinisterofForeignAffairs；
（3）theheadofagovernmentaldepartmentofthePeople'sRepublicofChinawhonegotiatesandsignstheagreementsconcludedinthenameofhisdepartment，unlessitisotherwiseagreedbythecontractingparties；
（4）theperson，dispatchedtoaninternationalconferenceoraccreditedtoaninternationalorganizationbythePeople'sRepublicofChina，whoisatthesametimetherepresentativefornegotiatingtreatiesoragreementsinthatconferenceororganization，unlessitisotherwiseagreedbytheconferenceorotherwiseprovidedforintheconstitutionoftheorganization.
Article7TheratificationoftreatiesandimportantagreementsshallbedecideduponbytheStandingCommitteeoftheNationalPeople'sCongress.
Thetreatiesandimportantagreementsreferredtointheprecedingparagraphareasfollows：
（1）treatiesoffriendshipandcooperation，treatiesofpeaceandsimilartreatiesofapoliticalnature；
（2）treatiesandagreementsrelatingtoterritoryanddelimitationofboundarylines；
（4）treatiesandagreementswhichcontainstipulationsinconsistentwiththelawsofthePeople'sRepublicofChina；
（5）treatiesandagreementswhicharesubjecttoratificationasagreedbythecontractingparties；and
（6）othertreatiesandagreementssubjecttoratification.
Afterthesigningofatreatyoranimportantagreement，theMinistryofForeignAffairsorthedepartmentconcernedundertheStateCouncilinconjunctionwiththeMinistryofForeignAffairsshallsubmitittotheStateCouncilforexaminationandverification；theStateCouncilshallthenreferittotheStandingCommitteeoftheNationalPeople'sCongressfordecisiononratification；thePresidentofthePeople'sRepublicofChinashallratifyitinaccordancewiththedecisionoftheStandingCommitteeoftheNationalPeople'sCongress.
Afterthesigningofthetreatiesandagreementslistedintheprecedingparagraph，theformalitiesofratification，approval，entryontherecordorregistrationshallbeexecutedasthecaserequiresinaccordancewithArticles7，8or9ofthisLaw.TheformalitiesofnotificationbynoteshallbecompletedbytheMinistryofForeignAffairs.
（1）toaccedetoamultilateraltreatyoranimportantmultilateralagreementlistedinParagraph2，Article7ofthisLaw，theMinistryofForeignAffairsorthedepartmentconcernedundertheStateCouncilinconjunctionwiththeMinistryofForeignAffairsshallmakearecommendationafterexaminationandsubmitittotheStateCouncilforexaminationandverification；theStateCouncilshallthenreferittotheStandingCommitteeoftheNationalPeople'sCongressfordecisiononaccession.TheinstrumentofaccessionshallbesignedbytheMinisterofForeignAffairs，andthespecificformalitiesexecutedbytheMinistryofForeignAffairs；
（2）toaccedetoamultilateraltreatyoragreementotherthanthoselistedinParagraph2，Article7ofthisLaw，theMinistryofForeignAffairsorthedepartmentconcernedundertheStateCouncilinconjunctionwiththeMinistryofForeignAffairsshallmakearecommendationafterexaminationandsubmitittotheStateCouncilfordecisiononaccession.
TheinstrumentofaccessionshallbesignedbytheMinisterofForeignAffairs，andthespecificformalitiesexecutedbytheMinistryofForeignAffairs.
Article12ThedecisiontoacceptamultilateraltreatyoranagreementshallbemadebytheStateCouncil.
InthecaseofamultilateraltreatyoragreementcontainingclausesofacceptancewhichissignedbytheChineserepresentativeordoesnotrequireanysignature，theMinistryofForeignAffairsorthedepartmentconcernedundertheStateCouncilinconjunctionwiththeMinistryofForeignAffairsshallmakearecommendationafterexaminationandsubmitittotheStateCouncilfordecisiononacceptance.TheinstrumentofacceptanceshallbesignedbytheMinisterofForeignAffairs，andthespecificformalitiesexecutedbytheMinistryofForeignAffairs.
Foragreementsonspecificlinesofbusinessandtreatiesandagreementsconcludedwithinternationalorganizations，asinglelanguagefairlycommonlyusedinternationallymayalsobeusedbyagreementofthetwocontractingpartiesorinaccordancewiththeprovisionsoftheconstitutionsoftheinternationalorganizationsconcerned.
Article15AtreatyoranimportantagreementofwhichtheStandingCommitteeoftheNationalPeople'sCongresshasdecidedonratificationoraccessionshallbepublishedinthebulletinoftheStandingCommitteeoftheNationalPeople'sCongress.ThemeasuresforpublishingothertreatiesandagreementsshallbemadebytheStateCouncil.
Article16TreatiesandagreementsconcludedbythePeople'sRepublicofChinashallbecompiledbytheMinistryofForeignAffairsintoacollectionoftheTreatiesofthePeople'sRepublicofChina.
Article17TreatiesandagreementsconcludedbythePeople'sRepublicofChinashallberegisteredwiththeSecretariatoftheUnitedNationsbytheMinistryofForeignAffairsinaccordancewiththerelevantprovisionsoftheUnitedNationsCharter.TreatiesandagreementsconcludedbythePeople'sRepublicofChinathatrequireregistrationwithotherinternationalorganizationsshallberegisteredbytheMinistryofForeignAffairsorthedepartmentsconcernedundertheStateCouncilinaccordancewiththerespectiveconstitutionsoftheinternationalorganizations.
Article18TheproceduresfortheconclusionofatreatyoranagreementwithaninternationalorganizationbythePeople'sRepublicofChinashallfollowthisLawandtheconstitutionoftherelevantinternationalorganization.
Article21ThisLawshallenterintoforceasofthedateofpromulgation
