ItisthepolicyofmyAdministrationtoadvancetheseobjectivesinordertoimproveoureconomyandpublichealth,boostenergysecurity,secureconsumersavings,advanceenvironmentaljustice,andaddresstheclimatecrisis.
Sec.2.Light-,Medium-,andCertainHeavy-DutyVehiclesMulti-PollutantandFuelEconomyStandardsfor2027andLater.
(a)TheAdministratoroftheEnvironmentalProtectionAgency(EPA)shall,asappropriateandconsistentwithapplicablelaw,considerbeginningworkonarulemakingundertheCleanAirAct(42U.S.C.7401-7671q)toestablishnewmulti-pollutantemissionsstandards,includingforgreenhousegasemissions,forlight-andmedium-dutyvehiclesbeginningwithmodelyear2027andextendingthroughandincludingatleastmodelyear2030.
(b)TheSecretaryofTransportationshall,asappropriateandconsistentwithapplicablelaw,considerbeginningworkonarulemakingundertheEnergyIndependenceandSecurityActof2007(PublicLaw110-140,121Stat.1492)(EISA)toestablishnewfueleconomystandardsforpassengercarsandlight-dutytrucksbeginningwithmodelyear2027andextendingthroughandincludingatleastmodelyear2030.
(c)TheSecretaryofTransportationshall,asappropriateandconsistentwithapplicablelaw,considerbeginningworkonarulemakingunderEISAtoestablishnewfuelefficiencystandardsforheavy-dutypickuptrucksandvansbeginningwithmodelyear2028andextendingthroughandincludingatleastmodelyear2030.
Sec.3.Heavy-DutyEnginesandVehiclesMulti-PollutantStandardsfor2027andLater.(a)TheAdministratoroftheEPAshall,asappropriateandconsistentwithapplicablelaw,considerbeginningworkonarulemakingundertheCleanAirActtoestablishnewoxidesofnitrogenstandardsforheavy-dutyenginesandvehiclesbeginningwithmodelyear2027andextendingthroughandincludingatleastmodelyear2030.
(b)TheAdministratoroftheEPAshall,asappropriateandconsistentwithapplicablelaw,andinconsiderationoftherolethatzero-emissionheavy-dutyvehiclesmighthaveinreducingemissionsfromcertainmarketsegments,considerupdatingtheexistinggreenhousegasemissionsstandardsforheavy-dutyenginesandvehiclesbeginningwithmodelyear2027andextendingthroughandincludingatleastmodelyear2029.
Sec.4.Medium-andHeavy-DutyEnginesandVehiclesGreenhouseGasandFuelEfficiencyStandardsasSoonas2030andLater.(a)TheAdministratoroftheEPAshall,asappropriateandconsistentwithapplicablelaw,considerbeginningworkonarulemakingundertheCleanAirActtoestablishnewgreenhousegasemissionsstandardsforheavy-dutyenginesandvehiclestobeginassoonasmodelyear2030.
(b)TheSecretaryofTransportationshall,asappropriateandconsistentwithapplicablelaw,considerbeginningworkonarulemakingunderEISAtoestablishnewfuelefficiencystandardsformedium-andheavy-dutyenginesandvehiclestobeginassoonasmodelyear2030.
Sec.5.RulemakingTargets.(a)Withrespecttotherulemakingdescribedinsection3(a)ofthisorder,theAdministratoroftheEPAshall,asappropriateandconsistentwithapplicablelaw,considerissuinganoticeofproposedrulemakingbyJanuary2022andanyfinalrulemakingbyDecember2022.
(b)Withrespecttotheotherrulemakingsdescribedinsection2andsection4ofthisorder,theSecretaryofTransportationandtheAdministratoroftheEPAshall,asappropriateandconsistentwithapplicablelaw,considerissuinganyfinalrulemakingsnolaterthanJuly2024.
Sec.6.CoordinationandEngagement.(a)TheSecretaryofTransportationandtheAdministratoroftheEPAshallcoordinate,asappropriateandconsistentwithapplicablelaw,duringtheconsiderationofanyrulemakingspursuanttothisorder.
(b)TheSecretaryofTransportationandtheAdministratoroftheEPAshallconsultwiththeSecretariesofCommerce,Labor,andEnergyonwaystoachievethegoalslaidoutinsection1ofthisorder,toaccelerateinnovationandmanufacturingintheautomotivesector,tostrengthenthedomesticsupplychainforthatsector,andtogrowjobsthatprovidegoodpayandbenefits.
(d)Incarryingoutanyoftheactionsdescribedinthisorder,theSecretaryofTransportationandtheAdministratoroftheEPAshallseekinputfromadiverserangeofstakeholders,includingrepresentativesfromlaborunions,States,industry,environmentaljusticeorganizations,andpublichealthexperts.
Sec.7.GeneralProvisions.(a)Nothinginthisordershallbeconstruedtoimpairorotherwiseaffect:(i)theauthoritygrantedbylawtoanexecutivedepartmentoragency,ortheheadthereof;or(ii)thefunctionsoftheDirectoroftheOfficeofManagementandBudgetrelatingtobudgetary,administrative,orlegislativeproposals.(b)Thisordershallbeimplementedconsistentwithapplicablelawandsubjecttotheavailabilityofappropriations.
(c)Thisorderisnotintendedto,anddoesnot,createanyrightorbenefit,substantiveorprocedural,enforceableatlaworinequitybyanypartyagainsttheUnitedStates,itsdepartments,agencies,orentities,itsofficers,employees,oragents,oranyotherperson.
