otherwise一词的使用比较灵活，但基本都离不开它的基本意思：differently，orinanotherway（别样地，以另外的方式）。汉语法律条文中的“另有规定除外”，可以翻译为unlessotherwiseregulated/providedby/specified/stipulated，比如“除非信用证另有规定”可译为unlessotherwisestipulatedintheLetterofCredit；“除非合同另有规定”可译为unlessotherwisespecifiedinthecontract；“除非本法另有规定”可译为UnlessotherwiseprovidedbytheLaw；等等。要掌握otherwise在法律英语中的使用，需熟悉其常用的搭配情况。
一、unlessotherwise：除非……；……除外
例1：Unlessotherwiseagreed,thegoodsremainattheseller’sriskuntilthepropertyinthemistransferredtothebuyer,butwhenthepropertyinthemistransferredtothebuyerthegoodsareatthebuyer’sriskwhetherdeliveryhasbeenmadeornot.
参考译文：除非另有协议，货物的风险直到货物所有权转移至买方时才从卖方转移至买方；货物所有权转移至买方的，不论货物是否已经交付，风险均转移至买方。
例2：因不可抗力不能履行合同或者造成他人损害的，不承担民事责任，法律另有规定的除外。
参考译文：Thereisnocivilliabilityfornon-performanceofacontractorfordamagedonetosomeoneowingtoforcemajeure,unlessotherwiseregulatedbylaw.
二、orotherwise：其他……；其他方式（方法）
例3：Anypersonwhobythreats,persuasionorotherwiseinducesawitnessorapartynottogiveevidenceinanyhearingbeforetheBoardcommitsanoffence.
参考译文：任何人借威胁、怂恿或其他手段诱使证人或一方当事人不在仲裁处聆讯中作证，即属犯罪。
三、otherwisethan：除……外
例4：“Paidupotherwisethanincash”meanspaidupotherwisethanby,cashreceivedbytheCompany,orachequereceivedbytheCompany,orareleaseofaliabilityoftheCompanyforaliquidatedsumoranundertakingtopaycashtothecompanyatafuturedate,and“cash”includesforeigncurrency.
参考译文：“非现金支付”系指通过公司收到的现金或支票，或通过对公司清偿款项的债务免除，或通过在未来日期向公司支付现金的承诺以外的其他方式进行的支付；其中，“现金”包括外币。
四、unless...providesotherwise：……另有规定的除外
例5：因共有的不动产或者动产产生的债权债务，在对外关系上，共有人享有连带债权、承担连带债务，但是法律另有规定或者第三人知道共有人不具有连带债权债务关系的除外；在共有人内部关系上，除共有人另有约定外，按份共有人按照份额享有债权、承担债务，共同共有人共同享有债权、承担债务。偿还债务超过自己应当承担份额的按份共有人，有权向其他共有人追偿。（《民法典》第307条）
